6.K. - Page 14 of 24 <br />EXHIBIT B <br />Redwood <br />CityI California <br />City Founded1867 <br />Personal Delivery Device Agreement <br />This Personal Delivery Device Agreement ("PDD Agreement") is entered into on <br />, 2019 ("Agreement Date"), by and between the City of Redwood City, a California <br />charter city and municipal corporation ("City"), and <br />("Permittee") <br />A. WHEREAS, the City owns or has jurisdiction over public or quasi -public <br />rights of way (including, but not limited to thoroughfares, streets, roads, alleys, lanes, <br />walkways, public spaces, sidewalks, crosswalks, driveways, and other right of way, <br />except streets and highways forming part of the state highway) in the City of Redwood <br />City whether or not improved or accepted for maintenance by City (individually and <br />collectively, "Right of Way"). <br />B. WHEREAS, "Personal Delivery Device "or "PDD" means an autonomous <br />robot or similar device powered by an electric motor, for use primarily on sidewalks, <br />capable of transporting items with or without an operator directly controlling the device; <br />identifying and yielding to pedestrians, bicyclists, other lawful users of public space, and <br />property; navigating public thoroughfares; and interpreting traffic signals and signs at <br />crosswalks. <br />C. WHEREAS, on May 6, 2019, the City Council passed a Resolution <br />instituting a 24 -month pilot program that commences on May 7, 2019, to allow continued <br />use of PDDs to deliver goods from Redwood City businesses to customers ("2019 Pilot <br />Program"). <br />D. WHEREAS, Permittee seeks a Personal Delivery Device permit ("PDD <br />Permit") to operate PDDs <br />[state purpose]. <br />E.
