05/06/2019 <br />33A.9 of this Article, and paid in advance any fee required and agrees to such <br />conditions as are imposed in the permit; <br />3. The time, duration and size of the temporary street closure will not substantially <br />disrupt the orderly and safe movement of other traffic: <br />4. The temporary street closure is of a size or nature such that it will not require the <br />diversion of so great a number of police officers of the City to properly police the <br />areas contiguous thereto, so as to prevent normal police protection to the City; <br />5. The concentration of persons will not unduly interfere with proper fire and police <br />protection of, or ambulance service to, areas contiguous to such street closure; <br />6. The temporary street closure will not interfere with the movement of fire -fighting <br />equipment en route to a fire; <br />7. The temporary street closure will not unduly interfere with the orderly operation <br />of parks, hospitals, churches, schools or other public and quasi -public institutions <br />in the City; <br />8. The applicant has provided reasonable means for informing all persons listed in <br />Section 33A.3(B)(1) and all persons participating in a temporary street closure of <br />the terms and conditions of such permit and the applicable laws thereto; <br />9. The temporary street closure will not conflict with or interfere with another <br />temporary street closure for which a permit has been granted: <br />10. A majority of owners, residents, or tenants of the properties fronting any <br />street(s) to be temporarily closed in a residentially zoned area have given <br />written consent to the closure: and <br />11. One hundred percent (100%) of the operators of the businesses fronting any <br />street(s) to be temporarily closed in a commercially zoned area have given written <br />consent to the closure, unless the special event is charitable in nature and <br />C. A special event permit (within the Courthouse Square Event Area) shall be issued by <br />the Chief of Police if he/she finds that all of the following circumstances exist: <br />1_ The applicant has not knowingly and with intent to deceive, made any false, <br />misleading or fraudulent statements of material fact in the application for a permit <br />or in any other document required pursuant to this Article; <br />2. The applicant has met the requirements of Section 33A.3(B), Section 33A.4 <br />through Section 33A.6, Section 33A.7(B)-(C). and Section 33A.8 through Section <br />33A.9 of this Article, and paid in advance any fee required and agrees to such <br />conditions as are imposed in the permit; <br />3.
