05/06/2019 Permittee for City. Permittee shall increase coverage limits upon written demand of City provided that said increases are reasonable and justifiable by City. D. Damage to Permittee Property. Permittee hereby waives any recovery of damages against City (including its employees, officers, directors, agents, or representatives) for loss or damage to any structures, tenant improvements and betterments, fixtures, equipment, and any other personal property. E. Cyber Liability Insurance. Permittee must carry Cyber Liability Insurance with limits not less than $1,000,000 per claim. Coverage shall be sufficiently broad to respond to the duties and obligations as is undertaken by Permittee in this Agreement and under the PDD Permit and shall include, but not be limited to, claims involving infringement of intellectual property, including but not limited to infringement of copyright, trademark, trade dress, invasion of privacy violations, information theft, damage to or destruction of electronic information, release of private information, alteration of electronic information, extortion and network security. The policy shall provide coverage for breach response costs as well as regulatory fines and penalties, as well as credit monitoring expenses with limits sufficient to respond to these obligations. The policy shall provide that the City and its officers, officials, employees, and agents shall be additional insureds, and the policy shall be primary and non-contributory. F. Other insurance provisions. The policies are to contain, or be endorsed to contain the following provisions. i. Additional Insured. City, its officers, agents, employees, and volunteers are to be covered as an additional insured as respects: Liability arising out of activities performed by or on behalf of Permittee and operations of Permittee, premises owned, occupied, or used by Permittee. The coverage shall contain no special limitations on the scope or protection afforded to City, its officers, officials, employees, agents, or volunteers. Except for worker's compensation insurance, the policies mentioned in this subsection shall name City as an additional insured and provide for thirty (30) days prior notice to City of any cancellation or change in coverage.
