IMPROVEMENT AGREEMENT (851 Main Street) THIS IMPROVEMENT AGREEMENT ("Agreement") is made and entered into on this6ay of - AMI 20L'J"Effective Date") by and between by and between 855 Main Street RWC, LLC, a California Limited Liability Company ("Developer"), and the CITY OF REDWOOD CITY, a charter city and California municipal corporation ("City") with reference to the following facts: RECITALS A. Developer is the current fee owner of that certain real property consisting of approximately 0.64 acres located within the City of Redwood City, County of San Mateo, State of California, described in Exhibit A, attached hereto and incorporated herein by reference (the "Property"). B. On June l ls', 2018, the City Council of the City of Redwood City adopted, among other approvals, Resolution No. 15676, approving the Vesting Tentative Map for 851 Main Street ("Project"), prepared by CSW/Stuber-Stroeh Engineering Group, Inc. and dated July 30', 2017 ("Tentative Map"), subject to certain conditions of approval ("Conditions"). C. The Conditions require either (1) that certain public improvements for the Project be constructed prior to approval of the Parcel Map ("Parcel Map"), or (2) that Developer enter into an agreement with City providing for the future construction of such public improvements. D. Developer has submitted the Parcel Map and applied to City for Parcel Map approval without having completed the required public improvements and, therefore, will enter into an agreement with City providing for the future construction and installation of such public improvements, as required by Government Code section 66462(a)(1). E. Developer has submitted to City plans, specifications and drawings entitled 851 Main Street, prepared by CSW/Stuber-Stroeh Engineering Group and dated :30n�a,y q 2018 (the "Improvement Plans"), which, in addition to other improvements, provide for certain on-site public improvements consisting of street and street light improvements, storm drain systems, domestic water systems and sanitary sewer systems for the Project (collectively, "Improvements"). F. City and Developer desire to enter this agreement providing for the construction and installation of the Improvements in accordance with the Improvement Plans.
