8.A. - Page 15 of 73 <br />Attachment B <br />Section 1.5. Provisions of Joint Powers Agreement in Effect. Except as <br />expressly modified herein, all of the provisions of the Joint Powers Agreement shall <br />remain in full force and effect. <br />Section 1.6. Effectiveness. This Ninth Supplement shall take effect on such <br />date that all Parties hereto have executed this Ninth Supplement. <br />Section 1.7. Partial Invalidity. If any section, paragraph, sentence, clause or <br />phrase of this Ninth Supplement shall for any reason be held illegal, invalid or <br />unenforceable, such holding shall not affect the validity of the remaining portions of this <br />Ninth Supplement. The Parties hereby declare that they each would have entered into <br />this Ninth Supplement and each and every other Section, paragraph, sentence, clause <br />or phrase hereof irrespective of the fact that any one or more Sections, paragraphs, <br />sentences, clauses, or phrases of this Ninth Supplement may be held illegal, invalid or <br />unenforceable. <br />Section 1.8. Execution in Counterparts. This Ninth Supplement may be <br />executed in several counterparts, each of which shall be an original and all of which <br />shall constitute but one and the same instrument. <br />Section 1.9. Governing Law.
