Code § 27383. <br />SANITARY SEWER UTILITIES MAINTENANCE AGREEMENT <br />115 Harcross Road, Woodside <br />THIS UTILITIES MAINTENANCE AGREEMENT ("Agreement") is made and entered into this <br />241h day of May , 2019 ("Effective Date"), by and between Wai Hung Yip and Cynthia Yip as <br />Trustees of the Hin & Zaak Family Trust dated December 16, 2013, ("Property Owner"), and the City of <br />Redwood City, a charter city and California municipal corporation ("City") with reference to the following <br />facts: <br />RECITALS <br />A. The Property Owner is the fee -title owner of real property commonly known as 115 Harcross <br />Road, Woodside, CA 94063 (the "Property"), as described in Exhibit "A," attached hereto and incorporated <br />by this reference as if fully set forth herein. <br />B. The Property Owner desires to discharge sewage consistent with effluent produced by one <br />single family home and its associated permitted structures/uses into the City's municipal waste water <br />collection system. <br />C. The City owns and has the rights of capacity and use of facilities for the transmission, <br />treatment and disposal of sewage. While the Property lies outside of the Redwood City boundaries, and <br />outside of the City's sphere of influence, the City is willing to provide waste water services to the Property <br />subject to the approval of appropriate agencies, including the San Mateo County Local Agency Formation <br />Commission. <br />D. The City owns and operates a municipal waste water collections system covered under a <br />Waste Discharge Requirements permit from the State Water Resources Control Board (WDID# <br />2SSO10168). <br />E. In connection with the City agreeing to provide waste water services, including the <br />collection, treatment and disposal of sanitary sewage discharged from the Property ("Services"), the <br />Property Owner will submit utility and street improvement plans ("Plans") to the City for approval. <br />F. The Plans provide for installation of one private sewer service lateral and one private sewer <br />manhole (the "Private Improvements") as well as a sewer main extension and necessary appurtenances that <br />will ultimately be dedicated to the City (the "Public Improvements"). The Private Improvements and Public <br />Improvements are collectively referred to herein as the "Improvements" and will be constructed within the <br />1 of 12 <br />REV: 5-23-19 PR <br />ATTY/AGR.2019.140/Yip — Sewer Maintenance Agreement <br />546 <br />
