Contractor shall maintain coverage as required by the California Labor Code and Employer's
<br />Liability limits with limits not less than $1,000,000 per each accident for bodily injury or disease.
<br />The Worker's Compensation policy shall contain an endorsement stating that the insurer waives
<br />any right to subrogation against the City, its officers, agents, employees, and volunteers. The
<br />Workers' Compensation and Employer's Liability Insurance will not be required if Consultant
<br />has no employees and provides, to the City's satisfaction, a declaration stating this.
<br />c. Liability Insurance
<br />Contractor shall take out and maintain during the term of this Agreement such bodily injury
<br />liability and property damage liability insurance and shall protect Contractor and all of its
<br />employees/officers/agents while performing work covered by this Agreement from any and all
<br />claims for damages for bodily injury, including accidental death, as well as any and all claims for
<br />property damage which may arise from Contractor's operations under this Agreement, whether
<br />such operations be by Contractor, any subcontractor, anyone directly or indirectly employed by
<br />either of them, or an agent of either of them. Such insurance shall be on an "occurrence" basis,
<br />combined single limit bodily injury and property damage for each occurrence and shall not be
<br />less than the amounts specified below:
<br />Comprehensive General Liability $2,000,000
<br />The City, its City Council, Commissions, Committees, Boards, officers, employees, volunteers
<br />and agents, shall be named as additional insured on any such policies of insurance, which shall
<br />also contain a provision that (a) the insurance afforded thereby to City, City Council,
<br />Commissions, Committees, Boards, Officers, Employees, Volunteers and Agents and shall be
<br />primary and non-contributory insurance to the full limits of liability of the policy and (b) if the
<br />City, its City Council, Commissions, Committees, Boards, Officers, Employees, Volunteers and
<br />Agents have other insurance against the loss covered by such a policy, such other insurance shall
<br />be excess insurance only.
<br />An endorsement precluding cancellation or reduction in coverage before the expiration of thirty
<br />(30) days after City will have received written notification of cancellation or reduction in
<br />coverage by first class mail.
<br />d. Auto Liability
<br />Auto liability insurance covering any auto (Code 1), or if Contractor has no owned autos, hired,
<br />(Code 8) and non -owned autos (Code 9), with limit no less than $1,000,000 per accident for bodily
<br />injury and property damage.
<br />Verification of Coverage: Contractor shall famish the City with certificates of Insurance
<br />including all required endorsements (or copies of the applicable policy language effecting
<br />coverage required by this clause) to the City before work begins.
<br />In the event of the breach of any provision of this Section, or in the event any notice is received
<br />which indicates any required insurance coverage will be diminished or canceled, City, at its
