filed with the State Office of Planning & Research under State Clearinghouse No. <br />2017042023; and <br />WHEREAS, on December 4, 2018, the Planning Commission (Commission) held a <br />duly noticed public hearing to receive public comment on the Draft EIR; and <br />WHEREAS, the City prepared written responses to the comments received during <br />and immediately following the public review and comment period and included these <br />responses in a separate volume entitled "Final Environmental Impact Report for the <br />Broadway Plaza Project — Responses to Comments and Revisions to the Draft EIR" which <br />together with the Draft EIR constitutes the Final Environmental Impact Report (Final EIR), <br />and also prepared a Mitigation Monitoring and Reporting Program (MMRP) pursuant to the <br />requirements of CEQA and the CEQA Guidelines; and <br />WHEREAS, in addition to the public Scoping Session, eight official noticed public <br />meetings and hearings of various City commissions and the Planning Commission were <br />held to deliberate the merits of the proposed Project and make recommendations regarding <br />components of or a final action on the Project. <br />NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION <br />OF THE CITY OF REDWOOD CITY, AS FOLLOWS: <br />Section 1. The Commission, having independently heard, considered, and <br />weighed all the evidence in the record, finds that the above recitals are accurate and <br />constitute findings in this matter and, together with the staff report and the application <br />materials, including without limitation the Final EIR, development plan, and all other <br />documents, reports, studies, memoranda, maps, oral and written testimony, and <br />materials in the City's file for the applications and the Project, and all adopted City <br />planning documents relating to the Project and the property including the City's General <br />Plan, Municipal Code, Zoning Ordinance, and other applicable City laws and regulations, <br />and all associated approved and certified environmental documents, have together <br />served as an adequate and appropriate evidentiary basis for the findings and actions set <br />forth in this Resolution and are hereby incorporated by reference. <br />Section 2. CEQA. The Commission recommends that the Council find, based on <br />its independent judgment and analysis, that the Final EIR, which is on file in the Office of <br />the City Clerk of the City of Redwood City, and incorporated herein by this reference, is <br />hereby certified based on the following findings: <br />a. The City of Redwood City is the lead agency under CEQA for preparing <br />the Final EIR, and is the entity with final decision-making authority with <br />regard to approval of the proposed project. <br />b. The Final EIR has been completed in compliance with CEQA (Public <br />Resources Code Section 21000 et seq.) and the CEQA Guidelines (Title <br />14, Section 15000 et seq., of the California Code of Regulations) and <br />the applicable provisions of the Redwood City Municipal Code. <br />ATTY/RES0.0036/PC RESO CERTIFYING THE EIR — SOBRATO <br />REV: 04-29-19 PR <br />Page 2 of 29 <br />
