A separate resolution addresses certification of the EIR, CEQA findings and <br />includes a statement of overriding considerations; and <br />WHEREAS, the Commission is empowered by the City of Redwood City Zoning <br />Ordinance, the Redwood City Code and the Subdivision Map Act to consider the Project; and <br />WHEREAS, the Project will ultimately be considered by the City Council due to the need <br />for an amendment to the Recycled Water Service Area for the Bay Road portion of the Project <br />under Redwood City Code Chapter 38, Article VIII (Recycled Water Use); and <br />WHEREAS, on April 24, 2019, the Commission considered the staff reports, oral and <br />written, and testimony and materials presented by all those wishing to be heard on this Project at <br />the duly noticed public hearing on this matter; and <br />WHEREAS, on April 24, 2019, the Commission conducted a duly noticed public <br />hearing, in accordance with all applicable requirements of the State Planning and Zoning Law, <br />the Redwood City Code, and the Redwood City Zoning Ordinance, to consider recommending <br />approval of the Project, and received and considered oral and written reports and application <br />materials; and <br />WHEREAS, the Commission adopted a Resolution recommending that the City Council <br />certify the Final EIR for the Project, and adopt CEQA findings and a Mitigation Monitoring and <br />Reporting Plan, in accordance with the requirements of CEQA; and <br />WHEREAS, the Commission has determined that the proposed Project is consistent <br />with the General Plan goals and Zoning District standards and other applicable provisions of the <br />Redwood City Municipal Code and Zoning Ordinance, and Subdivision Map Act. <br />NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: <br />Section 1. Evidentiary Basis: The Commission, having independently heard, <br />considered, and weighed all the evidence in the record, finds that the above recitals are accurate <br />and constitute findings in this matter and, together with the staff report and the application <br />materials, including without limitation the EIR, development plan, tentative map, and all other <br />documents, reports, studies, memoranda, maps, oral and written testimony, and materials in <br />the City's file for the applications and the Project, and all adopted City planning documents <br />relating to the Project and the property including the City's General Plan, Municipal Code, <br />Zoning Ordinance, and other applicable City laws and regulations, and all associated approved <br />and certified environmental documents, have together served as an adequate and appropriate <br />evidentiary basis for the findings and actions set forth in this Resolution. <br />Architectural Permit: <br />a. The existence of sufficient variety in the design of the structure and grounds to <br />avoid monotony in the external appearance; <br />Basis for finding: The buildings are well designed with vertical and horizontal <br />articulation to differentiate the individual units and provide visual interest.
