h. In the case of any commercial or industrial structure, the review authority shall <br />consider its proximity to any R District and shall consider the effect of the <br />proposed structure upon the character and value of the adjacent R District area; <br />The finding does not apply as the Project is not directly adjacent to any R <br />District. <br />The provision of permeable areas and drainage design appropriate to capture <br />and treat stormwater runoff prior to its discharge from the site including, but not <br />limited to, the use of vegetated swales, landscape features, permeable <br />pavement materials, infiltration basins or engineered designs. <br />The City's Engineering division has reviewed the Project's landscape features <br />and areas, and bio-swale areas to capture and treat stormwater run-off prior to <br />discharge from the site, and determined that the Project would comply. <br />Section 3. Planned Development Permit: The proposed Project includes office, retail, <br />residential and child care space and publicly -accessible open space. Offsite improvements and <br />other implementation measures are included in the project are consistent with the requirements <br />of the Mixed Use Corridor — Gateway Broadway Zoning District. The Planning Commission finds <br />that approval of a Planned Development Permit is appropriate for the proposed Project, as <br />follows: <br />a. Permit Finding. The design and construction quality contained in all aspects <br />of the development plan is expected to exceed the quality standards typically <br />required for new developments located in similar zoning districts. <br />With the Conditions of Approval (Exhibit A), the project is consistent with the <br />purpose of the Planned Development permit which promotes highest quality <br />architectural solutions and encourages the development of quality open space <br />and recreational opportunities within the project, because the project provides <br />1.6 acres of publicly accessible open space, including a dog park and other <br />recreational amenities, along with buildings of high design quality, including <br />site placement, massing, articulation and materials that meet the standards of <br />the zoning district and promote a walkable urban environment at the gateway <br />to the City. <br />b. Finding for Modification to Development Standards. The proposed <br />development will provide an environment of physical and functional desirability, <br />in harmony with the character of the surrounding neighborhood or district. <br />The project provides shared underground parking that promotes the goals of <br />the General Plan and Zoning District, preserving land area for affordable <br />housing, public open space, employment centers and child care. The shared <br />parking between the residential and office space makes efficient use of the <br />parking facilities and, with the Transportation Demand Management Plan, will <br />be adequate for anticipated demand. <br />Section 4. Vesting Tentative Map: The project requires approval of a Vesting Tentative <br />Map per the Subdivision Ordinance. In the exercise of its independent judgement, the Commission <br />finds that: <br />a.
