Code § 27383. <br />LANDSCAPE MAINTENANCE AGREEMENT <br />CROSSING 900 <br />900 MIDDLEFIELD ROAD AND 900 JEFFERSON AVENUE <br />THIS LANDSCAPE MAINTENANCE AGREEMENT ("Agreement") is made and entered into <br />this 1CW day of 1),�z 2019 ("Effective Date"), by and between Redwood City Partners, LLC, a <br />Delaware limited liability company ("Property Owner"), and the CITY OF REDWOOD CITY, a charter <br />city and California municipal corporation ("City") with reference to the following facts: <br />RECITALS <br />A. Reference is made to that certain real property situated in the City of Redwood City, <br />County of San Mateo, State of California, known as the Crossing 900 site (also commonly known as <br />"Block 2") and described on Exhibit "A", attached hereto and incorporated by this reference as if fully set <br />forth herein (the "Property"). <br />B. The Property Owner and City entered into that certain Disposition and Development <br />Agreement dated July 30, 2013 ("DDA") concerning the development of the Property. <br />C. The DDA included provisions in Article 5 for the maintenance of the Property. This <br />Agreement is intended to set forth in greater detail the maintenance obligations of the Property Owner <br />regarding the Property and to extend these obligations beyond the 10 -year period set forth in the DDA. <br />The maintenance obligations set forth herein are intended to go into effect immediately and continue in <br />perpetuity. <br />D. In connection with its development of the Property, the Property Owner submitted to the <br />City Improvement Plans, which include, inter alia, landscaping plans for along the Property frontage <br />("Plans"), all of which Plans have been approved by the City. The Plans provide for installation of certain <br />improvements, including landscaping, pedestrian lighting, and irrigation improvements ("Improvements") <br />within the project frontages of Middlefield Road and Winslow Street ("Maintenance Area") as the <br />Improvements and Maintenance Area are more specifically shown on Exhibit "B" attached hereto and by <br />this reference made a part hereof. <br />E.
