opinion of the City, by virtue of prior training and experience with the City of <br />Redwood City, to perform the work required in that related classification. <br />16.2 Order of Rehire <br />An employee who is laid off shall be placed, for a period of one (1) year from the <br />date of the employee's most recent layoff, on a rehire list (for the employee's <br />classification). In hiring for a vacant position in a classification, such rehire list <br />shall take precedence over all other employment lists and the last employee laid <br />off shall be the first employee rehired until the rehire list of employees is <br />exhausted; provided, however, that the employee hired from the rehire list is <br />capable, in the opinion of the City, by virtue of prior training and experience with <br />the City, to perform the work required in the classification in which the opening <br />exists. <br />16.3 Break in Service <br />Service with the City for the purpose of calculating seniority shall be terminated <br />by discharge, resignation, retirement or layoff. <br />16.4 Benefits During Layoff <br />During the one (1) year on a rehire list, the employee shall not accrue any <br />benefits, including, but not limited to, vacation, sick leave, holidays, medical, <br />dental, life insurance and uniform allowance. Any employee reemployed from <br />the rehire list shall return to all vacation and sick leave accrual rates for which <br />the employee was eligible at the time of layoff. <br />16.5 Length of Service <br />The department shall keep an up-to-date length of service list of all employees <br />covered by this MOU, and post the length of service list in a conspicuous place. <br />This provision is for the convenience of the parties and in case of any disputes <br />concerning the accuracy of the posted list, the grievance procedure may be <br />utilized. <br />SECTION 17 - RETIREMENT <br />17.1 Retirement Plan <br />Tier One: For employees hired prior to October 24, 2011, retirement benefits <br />shall be those established by the Public Employees' Retirement System (PERS) <br />for Local Safety Members Three Percent (3%) at Age Fifty (50) Formula. <br />Tier Two: For employees hired on or after October 24, 2011, who do not qualify <br />as "new members" under Government Code Section 7522.04(f), retirement <br />benefits shall be those established by the Public Employees' Retirement System <br />31 <br />
