11.4 Duration of Eligible List <br />Eligible lists shall continue in effect one (1) year after establishment. They may be extended for a period not <br />to exceed one (1) year or abolished before the expiration of the yearly period by the Personnel Officer upon <br />recommendation of the Department Head of the department to which the classification or position relating to <br />the eligible list is allocated. <br />11.5 Removal from Eligible List <br />The name of any employee on an eligible list may be removed by the Personnel Officer if the eligible employee <br />requests in writing that his/her name be removed, if he/she fails to respond to a written offer of employment <br />within five (5) business days next succeeding the mailing of notice, if a subsequent report of a character <br />investigation is unsatisfactory, or if he/she has been rejected for appointment three (3) times by a Department <br />Head. <br />11.6 Waiver of Employment Offer <br />A candidate may waive two (2) offers of employment without affecting his/her standing on the eligible list. <br />After the third offer of employment has been waived, the candidate shall be removed from the eligible list. <br />11.7 Time Off for Examination <br />Promotional examinations scheduled by the City during an employee's regular working hours may be taken <br />without any loss in compensation. <br />ARTICLE 12— RECLASSIFICATION <br />12.1 Definition <br />"Reclassification" is defined as assignment to a more appropriate class, whether newly titled or already titled, <br />due to gradual accretion of, or substantial change in an employee's duties, responsibilities, authority or <br />character of work not due to a temporary upgrade assignment. <br />12.2 During the term of this Agreement, the City shall notify the employee concerned in case of contemplated <br />change in job content as contained in the classification descriptions, which were in effect at the beginning of <br />this Agreement. The Union shall be notified in advance of any contemplated changes in classification <br />descriptions and such changes shall be subject to the meet and confer process during the term of this MOU. <br />If the Union and the City cannot reach agreement on the appropriate pay level for a job so reclassified, the <br />classification description shall revert to its former status. An employee required to perform duties outside of <br />his/herjob classification shall be compensated in accordance with the provision of Article 15.11. <br />12.3 During the window period of the months of September and October, an employee may request in writing a <br />reevaluation of his/her job based on significant changes in job content or significant discrepancies between <br />job content and the classification description. <br />The City will issue a determination on any reclassification request within ninety (90) calendar days from the <br />receipt of the request, however this timeline may be extended at the mutual consent of the City and the Union. <br />If meetings are held to discuss the requested reevaluation, the employee may request representation by the <br />Union. The City shall not agree to a change in the appropriate pay level for a job description until the Union <br />16 <br />
