LICENSEE is obligated to notice CMD offices listed <br />above and the failure to provide notice to do so shall constitute a lack of notice. Nothing <br />contained herein shall preclude the giving of any such notice by personal 'service. <br />IV. INSURANCE REQUIREMENTS <br />LICENSEE is a self-insured municipal corporation, which is required to furnish evidence <br />of sufficient insurance coverage; $2,000,000. LICENSEE will be responsible for any <br />damage caused to PREMISES and shall indemnify and hold harmless the CMD for any <br />injuries caused or incurred by its officers, agents or employees in use of PREMISES <br />under the license. <br />V. FEES <br />LICENSEE shall pay Nine Thousand Six Hundred Ninety -Four dollars ($9,694) monthly <br />through July 31, 2020 or fee transfer of facility, whichever shall occur first. If Close -of - <br />Escrow shall occur at month-end, rental fees shall be pro -rated at an amount of Three <br />Hundred Twenty -Three dollars ($323) per day through the date of title transfer. <br />VI. TERM <br />License shall be effective from August 1, 2019, and it shall expire on the earlier of July <br />31, 2020 or fee transfer of facility. <br />VII. AMENDMENT AND TERMINATION <br />AGREEMENT cannot be amended or modified in any way except by a written <br />AGREEMENT duly executed by the parties. Any proposal for amendment or modification <br />must be delivered for review and approval by the Chief, Realty Operations Branch or <br />his/her delegatee. <br />AGREEMENT may be terminated by either party upon 30 days written notification to the <br />other party at the addresses previously given in Section III. Upon termination, the <br />activities of the parties shall be governed by the applicable provisions of the Military and <br />Veterans Code.
