records are to include but are not limited to: <br />(i) Records providing a full description of the activities undertaken with the use <br />of the Loan funds; <br />(ii) Records demonstrating the eligibility of activities under CDBG Regulations <br />set forth in 24 C.F.R. 570 et seq. and that use of the CDBG Funds meets one of the <br />national objectives of the CDBG program set forth in 24 C.F.R. 570.208; <br />(iii) Records demonstrating that the HOME Funds have been used in compliance <br />with HOME Program requirements; <br />(iv) Records demonstrating compliance with the HUD property standards and <br />lead-based paint requirements; <br />(v) Records documenting compliance with the fair housing and equal opportunity <br />requirements; <br />(vi) Financial records as required by 24 C.F.R. 570.502, and OMB Circular A-110 <br />(24 C.F.R. Part 84); <br />(vii) Records demonstrating compliance with the CDBG and HOME Program <br />tenant selection, affordability and income requirements; <br />(viii) Records demonstrating compliance with MBEIWBE requirements; <br />(ix) Records demonstrating compliance with 24 C.F.R. Part 135 which implements <br />section 3 of the Housing Development Act of 1968; <br />(x) Records demonstrating compliance with applicable relocation requirements, <br />which must be retained for at least five (5) years after the date by which persons <br />displaced from the property have received final payments; <br />(xi) Records demonstrating compliance with labor requirements including certified <br />payrolls from Owner's general contractor evidencing that applicable prevailing <br />wages have been paid; and <br />(xii) Other records necessary to document compliance with Subpart K of 24 C.F.R. <br />Part 570. <br />3.7 Access to Records: Audits; Inspections. <br />3.7.1 The City shall notify the Owner in writing of any records it deems <br />insufficient.
