<br />WHEREAS, the portion of Bay Road being resurfaced lies within both the corporate <br /> <br />limits of the City and within unincorporated San Mateo County; and <br /> <br />WHEREAS, the City area to be resurfaced in accordance with this Agreement is shown <br /> <br />on Exhibit "A", attached to and incorporated herein by this reference; and <br /> <br />WHEREAS, the proposed resurfacing work of a portion of Bay Road shall include, but <br /> <br />not be limited to: planing, pavement repairs, placement of pavement reinforcing fabric, <br /> <br />placement of asphalt concrete, installation of pavement markings and pavement markers, <br /> <br />installation of concrete sidewalk access ramps, adjustment of water valve and anode boxes to <br /> <br />finished grade, and other items of work associated with this road resurfacing project; <br /> <br />NOW, THEREFORE, IT IS AGREED AS FOLLOWS: <br /> <br />1. The City grants the necessary permission to the County to do work within the City <br /> <br />limits as herein described and shown on Exhibit "A". <br /> <br />2. County will include in its contract, for the above-described project, road <br /> <br />resurfacing and concrete sidewalk access ramp work of "a portion of Bay Road within the <br /> <br />corporate limits of the City" ("City facilities"). The work shall be completed by the County's <br />Contractor. <br /> <br />3. County will award the contract to the lowest responsible bidder for the completion <br /> <br />of the resurfacing project including the City's portion of the road resurfacing and concrete <br /> <br />sidewalk access ramp work. The work shall be performed pursuant to and in accord with <br /> <br />standard County and City specifications. <br /> <br />4. County agrees to notify City of the successful bidder to whom the construction <br /> <br />contract is to be awarded. <br /> <br />Page 2 of5 <br />
