This document is recorded for the <br />benefit of the City of Menlo Park <br />and is entitled to be recorded free <br />of charge in accordance with <br />Sections 6103 and 27383 of the <br />Government Code. <br />RECORDING REQUESTED BY <br />AND WHEN RECORDED MAIL TO: <br />City of Menlo Park <br />Attn: City Clerk <br />701 Laurel Street <br />Menlo Park, CA 94025 <br />AFFORDABLE HOUSING AGREEMENT <br />AND <br />DECLARATION OF RESTRICTIVE COVENANTS <br />STATION 1300 PROJECT <br />THIS AFFORDABLE HOUSING AGREEMENT AND DECLARATION OF <br />RESTRICTIVE COVENANTS ("Agreement") is entered into as of <br />2017, by and between the CITY OF MENLO PARK, a California municipal corporation <br />("City"), and: LANDINGS INVESTMENTS, LLC, a California limited liability company <br />("Landings"), BAYFRONT INVESTMENTS, LLC, a California limited liability company <br />(`Bayfront"), and REAL SOCIAL GOOD INVESTMENTS, LLC, a California limited <br />liability company ("Real Social Good") (Landings, Bayfront, and Real Social Good are, <br />collectively, "Owner") (individually a "Party" and collectively the "Parties"), with reference to <br />the following facts: <br />I 7 V[N VI try <br />A. Owner is the owner of those certain parcels of real property collectively and <br />commonly known as Station 1300 in the City of Menlo Park, California ("Property") as more <br />particularly described in Exhibit A attached hereto. <br />B. The Parties have entered into a Development Agreement ("Development <br />Agreement"), effective of even date herewith, to facilitate development of the <br />Property subject to certain terms and conditions.
