16. Creek Maintenance Access - Provide for City staff access to the concrete -lined channel <br />by providing adequate space and a gate, in a manner and location on Maple Street as <br />determined by the City. The space and gate shall be included on the project plans. The City <br />and the applicant shall coordinate fencing and fence type to ensure safety and aesthetic <br />compatibility. The fence must be a minimum 42" in height, include a man -gate, and be <br />transparent with vertical pickets [COA][ENGINEERING] [PRCS] <br />17. Pedestrian Path — The proposed pedestrian path adjacent to the Caltrain railroad tracks <br />shall be maintained by the property owner unless otherwise specified by the City. Costs <br />would be paid for by the property owner. [COA] [PRCS] <br />18. City -owned Parcel — City owned property adjacent to the concrete drainage along Lathrop <br />Street must be accessible at all times, and may be utilized by the City at any time. Water -Efficient Landscaping — Provide a landscaping and irrigation plan conforming to <br />the California Water -Efficient Landscape Ordinance (AB 1881), including an automatic <br />irrigation system (drip, micro -spray, or bubblers) with a rain sensor, and show these <br />measures on the building permit plans. [COA][PLANNING] <br />20. Street Trees — Street trees shall be planted along Elm Street, Lathrop Street, and Maple <br />Street according to the approved plans. The tree species and location will be determined by <br />the City Engineer and Planning Manager. All street trees shall be 35'-0" on center, within 5'- <br />0" by 5-0" gates and frames, with arbor guards, and 24" box size. These improvements <br />shall be included as part of the building permit submittal package. Newly planted trees shall <br />be both irrigated and maintained by the applicant. [SDR][PLANNING] <br />RIS 0 <br />21. Parcel Map -Obtain approval and record a Parcel Map prior to building permit issuance. All <br />parcel maps shall include the lot configuration and proposed easements and conform to the <br />Subdivision Map Act and Chapter 30 of the Municipal Code. [SDR][ENGINEERING] <br />22. Agreements - Enter into the following agreements in a form acceptable to the City Attorney <br />and the Community Development Director. These agreements will be required at the time <br />of approval for the parcel map: [COA][ENGINEERING] <br />a. Affordable Housing Agreement. The applicant shall pay the required affordable <br />housing impact fee, estimated at $2,149,020, to HIP Housing to partially finance the <br />purchase of a 10 -unit property located at 3592 Rolison Road. No Temporary or Final <br />Certificate of Occupancy shall be issued unless and until (1) an affordable housing <br />agreement between the City, HIP Housing and the applicant, and a covenant or other <br />appropriate instrument restricting the units at a low-income level for a fifty-five (55) <br />year period, both meeting the requirements of the Affordable Housing Ordinance, have <br />been executed and recorded against the property located at 3592 Rolison Road, and <br />(2) the applicant pays the affordable housing impact fee to HIP Housing. If either <br />component listed above does not occur, then the applicant shall pay directly to the City <br />the required affordable housing impact fee prior to issuance of a Temporary Certificate <br />of Occupancy (TCO) or if no TCO is issued, then prior to issuance of a Final Certificate <br />of Occupancy.
