EXHIBIT D -1 FORM OF CONSTRUCTION OF IMPROVEMENTS PERMIT APPLICATION AND PERMIT PERMIT APPLICATION CITY AND COUNTY OF SAN FRANCISCO WSIP PROJECT CONSTRUCTION OF IMPROVEMENTS WITHIN THE CITY OF REDWOOD CITY The CITY AND COUNTY OF SAN FRANCISCO, a municipal corporation acting by and through its Public Utilities Commission ( "Applicant "), hereby applies for a permit from the CITY OF REDWOOD CITY ( "City ") to construct improvements as per attached plan(s) This permit application and the Construction of Improvements Permit ( "Permit ") to be issued pursuant to this application are made pursuant to and in accordance with the Memorandum of Agreement ( "MOK), dated August , 2009, by and between Applicant and City. The parties' respective insurance and indemnity obligations in connection with the construction work authorized by this Permit shall be as stated in the MOA.. (1) Applicant submits herewith a plan of the proposed construction, and a check for the sum of $ as an initial deposit to cover the checking of plans of the proposed construction. (20 Because Applicant (i) is a municipal corporation and (ii) all construction work authorized by the Permit will be performed pursuant to a contract between Applicant and its contractor that will require such contractor to provide a performance bond in favor of Applicant, no bond in favor of the City will be required from Applicant.
