07/12/2010 <br />RESOLUTION NO. 15039 <br />RESOLUTION OF THE COUNCIL OF THE CITY OF REDWOOD <br />CITY APPROVING ASSESSMENTS FOR THE SEAPORT <br />BOULEVARD LANDSCAPE MAINTENANCE DISTRICT AND <br />REQUESTING THAT THE COUNTY CONTROLLER LEVY THE <br />ASSESSMENTS <br />WHEREAS, on May 24, 2010, the City Council approved a Resolution of <br />Intention to levy assessments and ordered that notices be sent in accordance with the <br />requirements of Proposition 218 and the Proposition 218 Omnibus Implementation Act; <br />and <br />WHEREAS, on May 25, 2010, more than 45 days before the public hearing, <br />notices and ballots were provided to the record owners of each affected parcel and a <br />ballot was provided for the owners to vote on the proposed assessments for the period <br />2010 -2015; and <br />WHEREAS, there was no majority protest and more than a majority voted in <br />favor of the assessments being levied 63 % , Yes, 37 % , No; <br />NOW, THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL OF THE <br />CITY OF REDWOOD CITY AS FOLLOWS: <br />1. The City Council finds that the procedures required by Proposition 218 have <br />been met and that the proposed assessments may properly be approved by the City <br />Council. The City Council hereby approves the proposed assessments set forth in <br />Exhibit A, attached hereto, and further approves the budget for the years 2010 -2015 as <br />shown on Exhibit D entitled "Annual Maintenance Budget for Fiscal Years 2010 -2011 <br />through 2014 -2015 Seaport Boulevard Landscape Maintenance District provided to the <br />City Council on May 24, 2010. <br />2. The City Council requests that the County Controller include the assessments <br />shown on Exhibit A, attached hereto, in the County tax bills and further authorizes the <br />County Tax collector to collect the assessments at the same time and in the same <br />manner as taxes are collected. <br />ATTY /RESO /RESO.2026 #15039 <br />062910 MUFF # 507 <br />
