07/12/2010 RESOLUTION NO. 15039 RESOLUTION OF THE COUNCIL OF THE CITY OF REDWOOD CITY APPROVING ASSESSMENTS FOR THE SEAPORT BOULEVARD LANDSCAPE MAINTENANCE DISTRICT AND REQUESTING THAT THE COUNTY CONTROLLER LEVY THE ASSESSMENTS WHEREAS, on May 24, 2010, the City Council approved a Resolution of Intention to levy assessments and ordered that notices be sent in accordance with the requirements of Proposition 218 and the Proposition 218 Omnibus Implementation Act; and WHEREAS, on May 25, 2010, more than 45 days before the public hearing, notices and ballots were provided to the record owners of each affected parcel and a ballot was provided for the owners to vote on the proposed assessments for the period 2010 -2015; and WHEREAS, there was no majority protest and more than a majority voted in favor of the assessments being levied 63 % , Yes, 37 % , No; NOW, THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF REDWOOD CITY AS FOLLOWS: 1. The City Council finds that the procedures required by Proposition 218 have been met and that the proposed assessments may properly be approved by the City Council. The City Council hereby approves the proposed assessments set forth in Exhibit A, attached hereto, and further approves the budget for the years 2010 -2015 as shown on Exhibit D entitled "Annual Maintenance Budget for Fiscal Years 2010 -2011 through 2014 -2015 Seaport Boulevard Landscape Maintenance District provided to the City Council on May 24, 2010. 2. The City Council requests that the County Controller include the assessments shown on Exhibit A, attached hereto, in the County tax bills and further authorizes the County Tax collector to collect the assessments at the same time and in the same manner as taxes are collected.
