develop recommendations to the City Council regarding the New General Plan and the <br />Final EIR; and <br />WHEREAS, the City Council has reviewed the Planning Commission's <br />recommendations, and also reviewed the proposed New General Plan and all <br />environmental documents and supporting studies and reports necessary for certification <br />of the Final EIR and adoption of the proposed New General Plan; and has considered <br />the foregoing at a duly- noticed public hearing on October 11, 2010; and <br />WHEREAS, by this resolution, the City Council, as the lead agency under CEQA <br />for preparing the Final EIR, and as the entity with final decision - making authority with <br />regard to approval of the New General Plan, desires to comply with the requirements of <br />CEQA, the CEQA Guidelines, the applicable provisions of the California Government <br />Code, and the applicable provisions of the City's Municipal Code, in connection with the <br />adoption and subsequent implementation of the New General Plan. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF REDWOOD CITY, AS FOLLOWS: <br />A. The Final EIR, which is on file in the Office of the City Clerk of the City of <br />Redwood City, is hereby certified based on the following findings: <br />1. The Final EIR has been completed in compliance with the <br />California Environmental Quality Act (Public Resources Code Section 21000 et seq.), <br />the Guidelines for Implementation of the California Environmental Quality Act (Title 14, <br />Sections 15000 et seq. of the California Code of Regulations), and the applicable <br />provisions of the City of Redwood City Municipal Code. <br />2. The Final EIR has been reviewed and considered by the Planning <br />Commission and the City Council of the City of Redwood City prior to the City Council's <br />rendering any decision regarding the approval or adoption of the proposed New General <br />Plan. <br />3. The Final EIR reflects the City's independent judgment and has <br />been found and determined by the City to be adequate to support the City's action on <br />the proposed New General Plan. <br />4. Based on the City's review of the Final EIR, it has been determined <br />that, subject to any modifications and mitigation measures described in the Final EIR <br />and implemented through the Mitigation Monitoring and Reporting Plan, the proposed <br />New General Plan may have a significant effect on the environment, and the City <br />hereby adopts a statement of overriding considerations pursuant to Section 15093 of <br />the State CEQA Guidelines. <br />5. Pursuant to Section 15091 of the State CEQA Guidelines, the City's <br />action with respect to the New General Plan shall be based upon and subject to the <br />
