10/11/2010 <br />Attachment 1.A <br />FEIR Mitigation Measure 4.4 -3d (p. 4.4 -35 of the DEIR). <br />C) Findings. Based on the FEIR and the entire record before the City, <br />the City Council finds that Mitigation Measures 4.4 -3a through 4.4 -3d would reduce <br />program -level impacts to special status animal species to less than significant because the <br />mitigation measures would require that impacts to identified special status animals be <br />avoided, reduced or mitigated consistent with established federal and state standards and <br />requirements specifically applicable to the special status animal species, as described on <br />page 4.4-35 of the DEIR. <br />Impact 4.4 -4: Development allowed by the New General Plan could result in <br />the loss of habitat, mortality, or indirect impacts to special status avian species. <br />a) Potential Impact. The impact identified above is described and discussed <br />on page 4.4 -36 of the DEIR. <br />b) Mitigation Measures. The following mitigation measures are hereby <br />adopted and will be implemented as provided in the Mitigation Monitoring and Reporting <br />Program: <br />FEIR Mitigation Measure 4.4 -4a (p. 4.4 -36 of the DEIR). <br />FEIR Mitigation Measure 4.4 -4b (p. 4.4 -36 to 4.4 -37 of the DEIR). <br />C) Findings. Based on the FEIR and the entire record before the City, the <br />City Council finds that Mitigation Measures 4.4 -4a and 4.4 -4b would reduced program - <br />level impacts to migratory birds to less than significant because the mitigation measures <br />require proponents for future development or public improvement projects to consult <br />with the United States Fish and Wildlife Service and /or the California Department of Fish <br />and Game, prior to project approval, to identify measures to avoid or compensate for <br />impacts on special status avian species, which measures will be incorporated into the <br />project plans or required as conditions of approval. <br />Impact 4.4 -5: Development allowed by the New General Plan could result <br />in loss of or disturbance to active bat roosts and habitat of special status bat species. <br />a) Potential Impact. The impact identified above is described and discussed <br />on page 4.4 -37 of the DEIR. <br />b) Mitigation Measures. The following mitigation measures are hereby <br />adopted and will be implemented as provided in the Mitigation Monitoring and Reporting <br />Program: <br />FEIR Mitigation Measure 4.4 -5a (p. 4.4 -37 of the DEIR). <br />FEIR Mitigation Measure 4.4 -5b (p. 4.4 -37 to 4.4 -38 of the DEIR). <br />C) Findings.
