10/11/2010 <br />Attachment 1.A <br />4.5 Cultural Resources <br />Impact 4.5 -2: Construction activities, including site preparation and <br />grading, associated with new development allowed under the New General Plan <br />could adversely impact previously undiscovered archaeological resources due to <br />uncovering or unearthing these resources. <br />a) Potential Impact. The impact identified above is described and discussed <br />on page 4.5 -23 of the DEIR. <br />b) Mitigation Measures. The following mitigation measures are hereby <br />adopted and will be implemented as provided in the Mitigation Monitoring and Reporting <br />Program: <br />FEIR Mitigation Measure 4.5 -1a (p. 4.5 -23 to 4.5 -24 of the DEIR). <br />FEIR Mitigation Measure 4.5 -1b (p. 4.5 -24 to 4.5 -25 of the DEIR). <br />C) Findings. Based on the FEIR and the entire record before the City, <br />the City Council finds that Mitigation Measures 4.5-la and 4.5-lb would reduce the <br />impacts to archaeological resources to a less than significant level because the mitigation <br />measures require that (i) construction crews be trained regarding the possible presence <br />and identification of cultural resources and regarding laws and procedures for protecting <br />cultural resources, (ii) work that work be stopped if cultural resources are discovered on <br />the construction site, (iii) a qualified archaeologist be retained to evaluate the significance <br />of discovered resources, and (iv) appropriate steps be taken to avoid, protect and preserve <br />such resources as described in Mitigation Measure 4.5 -1(a) on page 4.5 -24 of the DEIR. <br />Impact 4.5 -3: Earth moving activities, particularly deep grading, associated <br />with the construction of new development allowed under the New General Plan has <br />the potential to destroy paleontological resources. <br />a) Potential Impact. The impact identified above is described and discussed <br />on page 4.5 -25 of the DEIR. <br />b) Mitigation Measures. FEIR Mitigation Measure 4.5 -2 (p. 4.5 -25 <br />of the DEIR) is hereby adopted and will be implemented as provided in the Mitigation <br />Monitoring and Reporting Program. <br />C) Findings. Based on the FEIR and the entire record before the <br />City, the City Council finds that Mitigation Measure 4.5 -2 would reduce the impacts <br />to paleontological resources to a less - than - significant level because the measure requires <br />(i) prior to the issuance of grading or demolition permits, an assessment or study by a <br />qualified paleontologist of the project's potential to destroy unique paleontological <br />resources, (ii) if appropriate, recommendations from the qualified paleontologist for <br />protecting unique resources, and (iii) work stoppage if any sensitive paleontological <br />resources are discovered to permit the implementation of steps to protect such resources. <br />AM /RESO /RESO.2055 /ATTACHMENT1.A 21 #15059 <br />10/13/10 MUFF # 601 <br />
