Page <br /> AT &T California <br /> 3475 B North First Street, Rm. 200 <br /> San Jose, CA 95134 <br /> RE: CONDITIONAL VACATION OF CHEMICAL WAY RIGHT -OF -WAY, INCLUDING THE <br /> PUBLIC SERVICES EASEMENT <br /> Dear Mr. Page, <br /> The City of Redwood City will be considering a resolution of intent to vacate the Chemical Way <br /> right -of -way and public services easement thereunder, subject to satisfaction of certain <br /> conditions (including approval of utility plans by all affected agencies utility providers), at a <br /> public hearing on December 21, 2010. Copies of the notice of public hearing, which includes a <br /> map showing the area proposed to be vacated and proposed resolution of intent to vacate are <br /> enclosed. <br /> As outlined in the resolution, the City and County of San Mateo have been working together <br /> over the last several months to locate a site for a County jail facility. Last month, the City and <br /> County entered into a Memorandum of Understanding ( "MOU ") regarding the proposed <br /> development of the jail facility on a site comprised of four parcels located at 20, 50, 70 and 80 <br /> Chemical Way within the Woodhouse Industrial Park. The MOU contemplates that the County <br /> will acquire the four parcels, demolish the existing improvements and develop a new jail facility <br /> on the assembled property. <br /> Pursuant to the MOU the County is currently in the process of preparing development plans, <br /> including plans for the relocation of utilities, and an environmental review of the proposed <br /> replacement jail facility. In order to provide County with assurances of the City's cooperation in <br /> the development of the jail facility, the City has agreed to proceed with a conditional vacation of <br /> the Chemical Way right -of -way, including the public services easement, with the understanding <br /> that such vacation will not take effect unless and until several conditions are met, one of which <br /> is that the County must obtain approval from all applicable agencies and utility providers of <br /> plans for relocation or removal and replacement of utility conduits and facilities currently located <br /> within the Chemical Way right -of -way.
