12/21/2010 <br /> whether Chemical Way right -of -way is unnecessary for present or prospective public <br /> use; and <br /> WHEREAS, City declares its intention to vacate the property herein described <br /> subject to the following conditions being satisfied to the satisfaction of the City Engineer: <br /> 1. That the County has acquired fee title to the entirety of the Woodhouse Industrial <br /> Park Property; <br /> 2. That the termination or expiration of all tenancies and relocation of all occupants <br /> from the Woodhouse Industrial Park Property has been achieved; <br /> 3. That the County has initiated demolition activities with respect to the existing <br /> improvements; <br /> 4. That the County has merged the four parcels comprising the Woodhouse <br /> Industrial Park Property into a single parcel; and <br /> 5. That the County has obtained approval from applicable agencies and utility <br /> providers of plans for relocation or removal and replacement of all utility conduits <br /> and facilities located with the Chemical Way right -of -way as may be required for <br /> County's development and use of the Woodhouse Industrial Park Property. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br /> REDWOOD CITY AS FOLLOWS: <br /> 1. The recitals set forth above are true and correct, and are hereby <br /> incorporated herein by this reference as if fully set forth in their entirety. <br /> 2. On December 21, 2010, the City Council held a public hearing and <br /> received evidence offered by interested persons and finds that Chemical Way right -of- <br /> way is unnecessary for present or prospective public purposes and therefore City shall <br /> vacate Chemical Way, subject to the conditions described herein; <br /> 3. The City declares that, because the vacation will be conditioned upon <br /> County's satisfaction of conditions 1 through 5 set forth above, City does not intend to <br /> reserve a Public Services Easement (PSE) over the formerly existing street; <br /> 4. The portion of Chemical Way to be vacated is more fully described in <br /> Exhibit A (map) and Exhibit B (legal description) attached hereto and by this reference <br /> incorporated herein. <br /> ATTY /RESO /RESO.2078 #15073 <br /> 121310 MUFF # 606 <br /> 2 <br />
