01/24/2011
Exhibit B
Reporting Program.
c) Findings. Based on the FEIR and the entire record before the City,
the City Council finds that Mitigation Measure 8 -1 will reduce impacts on emergency
response and evacuation to less than significant levels because it will require the City to
implement signal detectors at selected intersections as needed to provide priority traffic
signal timing for emergency response vehicles, with fair share participation in the cost of
implementation by new development in the DPP area.
9 Transportation and Circulation
Impact 9 -1: Project Impact on El Camino Real/Whipple Avenue Intersection.
Under Project Conditions during the PM peak hour, this intersection would
continue to operate at unacceptable LOS F. The additional project traffic would
cause the critical delay to increase by more than five (5) seconds.
a) Potential Impact. The impact identified above is described and discussed
on pages 9 -38 to 9 -48 of the DEIR.
b) Findings. Based on the FEIR and the entire record before the City, the
City Council finds that:
(i) Mitigation Measures. This impact could be mitigated as
described in Mitigation 9 -1 (p. 9 -48 of the DEIR) with the addition of an
exclusive eastbound left turn lane on Whipple Avenue and the conversion of the
eastbound shared left through lane on Whipple Avenue into an exclusive through
lane. However, due to roadway width constraints and the need to acquire right -of-
way from fronting commercial properties, these improvements may be infeasible.
In addition, any improvements within the El Camino Real right -of -way are within
the responsibility and jurisdiction of Caltrans, and not within the jurisdiction or
authority of the City. While the City believes these measures can and should be
adopted by Caltrans, because their implementation is outside of the City's
jurisdiction, it is deemed infeasible and therefore this impact is deemed to be
significant and unavoidable.
(ii) Remaining Impacts. Because there are no feasible mitigation
measures available to mitigate the significant impact identified above, this impact
is considered significant and unavoidable.
(iii) Overriding Considerations. The environmental, social,
economic and other benefits of the DPP override the significant adverse impacts
of the DPP relating to increased traffic described above, as set forth in the
Statement of Overriding Considerations below.
U:\Resolutions\2011 \Reso 15086 Exhibit B.doc 23
012011 Reso. # 15086
Muff #601
