01/24/2011 <br /> Exhibit B <br /> Impact 9 -9: Impacts on Transit Service. Build -out of the DPP would <br /> generate an estimated additional 106 AM peak hour transit trips and 147 PM peak <br /> hour transit trips, which would place additional demand on existing Caltrain, <br /> Samtrans, and shuttle service, as well as the streetcar proposed in the Draft New <br /> General Plan and the proposed future High Speed Rail service. <br /> a) Potential Impact. The impact identified above is described and discussed <br /> on pages 9 -56 to 9 -57 of the DEIR. <br /> b) Findings. Based on the FEIR and the entire record before the City, the <br /> City Council finds that: <br /> (i) Mitigation Measures. Mitigation of this project impact could be <br /> achieved by Mitigation Measure 9 -9 (p. 9 -57 of the DEIR) which requires that the <br /> City coordinate with Samtrans, Caltrain, and the High Speed Rail Authority to <br /> facilitate expanded transit services to the DPP area in pace with DPP - related <br /> increases in transit demand. However, given the long -term build -out of the DPP <br /> and the uncertainty of the existing and proposed transit facilities, equipment and <br /> services in the future, it cannot be determined at this time whether service <br /> enhancements would be implemented concurrently with increased demand such <br /> that acceptable service levels would be maintained. Therefore, the impacts of the <br /> DPP on transit service are currently deemed to be significant and unavoidable. <br /> (ii) Remaining Impacts. Because there are no feasible mitigation <br /> measures available to mitigate the significant impact identified above, this impact <br /> is considered significant and unavoidable. <br /> (iii) Overriding Considerations. The environmental, social, <br /> economic and other benefits of the DPP override the significant adverse impacts <br /> of the DPP relating to increased demand on transit services described above, as <br /> set forth in the Statement of Overriding Considerations below. <br /> Impact 9 -10: Cumulative Impact on EI Camino Real/Whipple Avenue <br /> Intersection. Under Cumulative With Project Conditions during the PM peak hour, <br /> this intersection would continue to operate at an unacceptable LOS F. The <br /> additional project traffic would cause the average delay to increase by more than <br /> five (5) seconds. <br /> a) Potential Impact. The impact identified above is described and discussed <br /> on pages 9 -58 to 9 -64 of the DEIR. <br /> b) Findings. Based on the FEIR and the entire record before the City, the <br /> City Council finds that: <br /> (i) Mitigation Measures. Mitigation of this project impact could be <br /> achieved by Mitigation Measure 9 -1 as discussed under Impact 9 -1, above.
