01/24/2011
Exhibit B
measures available to mitigate the significant impact identified above, this impact
is considered significant and unavoidable.
(iii) Overriding Considerations. The environmental, social,
economic and other benefits of the DPP override the significant adverse impacts
of the DPP relating to the cumulative traffic impacts described above, as set forth
in the Statement of Overriding Considerations below.
Impact 9 -21. Cumulative Impact on Veterans Boulevard/Whipple Avenue
Intersection. Under Cumulative With Project Conditions during both the AM and
PM peak periods, this intersection would continue to operate at an unacceptable
LOS (E or F). The additional project traffic would cause the critical delay to
increase by more than five (5) seconds for the PM peak hour.
a) Potential Impact. The impact identified above is described and discussed
on pages 9 -58 to 9 -64 of the DEIR.
b) Mitigation Measures. FEIR Mitigation Measure 9 -6 (p. 9 -51
of the DEIR) is hereby adopted and will be implemented as provided in the Mitigation
Monitoring and Reporting Program.
c) Findings. Based on the FEIR and the entire record before the City,
the City Council finds that Mitigation Measure 9 -6, discussed and adopted in Impact 9 -6
above, will reduce the project contribution to this cumulative impact to a less than
significant level because even though LOS at the identified intersection will continue to
operate at an unacceptable level, the change in the critical delay from Cumulative
Without Project Conditions would be reduced to less than five (5) seconds.
Impact 9 -22. Cumulative Impact on Veterans Boulevard/Woodside Road
Intersection. Under Cumulative With Project Conditions during both the AM and
PM peak periods, this intersection would continue to operate at an unacceptable
LOS F. The additional project traffic would cause the critical delay to increase by
more than five (5) seconds.
a) Potential Impact. The impact identified above is described and discussed
on pages 9 -58 to 9 -64 of the DEIR.
b) Findings. Based on the FEIR and the entire record before the City, the
City Council finds that:
(i) Mitigation Measures. With Mitigation Measure 9 -7 discussed in
Impact 9 -7 above, this intersection would continue to operate at an unacceptable
LOS F (107.3 sec /veh) in the AM peak hour and LOS F (162.8 sec /veh) in the PM
peak hour even though the change in the critical delay from Cumulative Without
Project Conditions would be reduced to less than five (5) seconds. Furthermore,
the improvements proposed under Mitigation Measure 9 -7 are within the
responsibility and jurisdiction of Caltrans, and can and should be adopted by
U:\Resolutions\2011\Reso 15086 Exhibit B.doc 38
012011 Reso. # 15086
Muff #601
