1 <br /> 01/24/2011 <br /> WHEREAS, on February 11, 2009, the court held that the EIR for the Downtown <br /> Precise Plan did not comply with CEQA in three specific respects, and issued a writ of <br /> mandate directing the City to set aside its certification of the EIR and adoption of the <br /> Downtown Precise Plan; and <br /> WHEREAS, between March and June of 2009, the City Council rescinded its <br /> certification of the EIR and adoption of the first Downtown Precise Plan, and directed <br /> City Staff to commence preparation of a second Downtown Precise Plan and EIR that <br /> would comply with those aspects of CEQA that were the bases of the court's writ of <br /> mandate; and <br /> WHEREAS, in March of 2010, the City Council held a public meeting on an <br /> updated and revised second Downtown Precise Plan and the Planning Commission <br /> held a public scoping meeting pursuant to CEQA to solicit public comments on a second <br /> EIR for the new Downtown Precise Plan; and <br /> WHEREAS, on August 31, 2010, the City published a second Draft EIR, which <br /> identified and evaluated the potential environmental effects of the new Downtown <br /> Precise Plan, and the publication of which initiated another 45 -day public review and <br /> comment period; and <br /> WHEREAS, between September and December of 2010, the City's Planning <br /> Commission held two more meetings to solicit public comments on the new Downtown <br /> Precise Plan and the second Draft EIR, and the City completed and made available for <br /> public review the second Final EIR for the Downtown Precise Plan; and <br /> WHEREAS, on December 14, 2010, the Planning Commission held a public <br /> hearing on the new Downtown Precise Plan and associated Final EIR, and based on its <br /> review and consideration of those documents, adopted a resolution recommending that <br /> the City Council of Redwood City certify the Final EIR as complying with CEQA and <br /> approve and adopt the new Downtown Precise Plan, subjects to those modifications <br /> described in the Final EIR as Alternative 4 and Alternative 5; and <br /> WHEREAS, on January 24, 2011 the City Council held a duly noticed public <br /> hearing on the proposed Downtown Precise Plan for the City of Redwood City, the City <br /> Council has considered the evidence and finds that the proposed Downtown Precise <br /> Plan is in the public interest and consistent with the purposes of the Redwood City <br /> Zoning Ordinance, and desires to adopt the Downtown Precise Plan with the <br /> modifications described as Alternatives 4 and 5 in the Final EIR;. and <br /> WHEREAS, throughout the process of consideration of a precise plan for the <br /> downtown area, beginning on May 30, 2006, the City has held a total of 14 public <br /> hearings and community workshops in which members of the public have had the <br /> opportunity to review and comment on the different versions of the Downtown Precise <br /> Plan, and concluded based on this extensive public outreach that the residents of <br /> Redwood City are overwhelmingly in favor of the proposed Downtown Precise Plan. <br /> ATTY /RESO /RESO.2093 Reso. # 15087 <br /> 011911 Muff # 601 <br />
