08/22/2011 <br /> WHEREAS, the City Council wishes to delegate authority to the Utilities <br /> Committee, a standing committee of the Council, to evaluate certain similar minor or <br /> temporary waivers and if appropriate, approve such waivers in the future. <br /> NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE <br /> CITY OF REDWOOD CITY, AS FOLLOWS: <br /> 1. The City Council approves a temporary waiver of Article 8.04 of the <br /> "Franchise Agreement Between the City of Redwood Ciry and Recology San Mateo <br /> County for Recyclable Materials, Organic Materials and Solid Waste Collection <br /> Services" in order to allow Recology to employ five (5) used collection vehicles through <br /> October 2011. <br /> 2. The City Council directs the Utilities Committee to act on behalf of the City <br /> Council to evaluate minor or temporary waivers of the Agreement, and authorizes the <br /> Utilities Committee to approve such waivers where: 1) the waiver does not impact <br /> overall service to customers, 2) the waiver has been recommended to member <br /> agencies by SBWMA, and 3) the waiver does not amount to an amendment of the <br /> Agreement or alter the fundamental terms of the Agreement. <br /> 3.
