09/19/2011 <br /> 1. The recitals set forth above are true and correct and are hereby <br /> incorporated by this reference as if fully set forth in their entirety. <br /> 2. Pursuant to Section 8331 of the Streets and Highways Code, the right of <br /> way within the Vacation Area is not used for public purposes, except for the fire hydrant <br /> and water line within the utility easement. <br /> 3. Public money was not expended for maintenance within the Vacation <br /> Area. <br /> 4. The right of way located in the Vacation Area depicted and described in <br /> Exhibit "A" is hereby ordered vacated conditioned upon the relocation of the fire <br /> hydrant and water line serving such hydrant to the satisfaction of the City Engineer. <br /> 5. The City Clerk is hereby authorized and directed to record a certified copy <br /> of this resolution with the County Recorder of the County of San Mateo. <br /> 6.
