02/13/2012 RESOLUTION N0.15169 RESOLUTION DENYING THE APPEALS FILED BY THE REDWOOD CITY CITIZENS FOR RESPONSIBLE DEVELOPMENT AND THE REDWOOD CITY LOCAL HOUSING COMMITTEE, AND UPHOLDING THE DECEMBER 13, 2011 PLANNING COMMISSION ACTIONS IN CONNECTION WITH THE CERTIFICATION OF THE ENVIRONMENTAL IMPACT REPORT AND APPROVALS OF THE PLANNED DEVELOPMENT PERMIT, VESTING TENTATIVE MAP AND MODIFICATION OF PARKING REQUIREMENTS FOR THE 2580 EL CAMINO REAL RESIDENTIAL PROJECT on November 3, 2010, Urban Housing Group ("Developer") applied for approval of a Planned Development Permit and Vesting Tentative Map to allow the demolition of the 2.5-acre project site's existing structures (a one-story bowling alley building (formerly Mel's Bowl), a historic pole sign and a large surface parking lot) and to build a 141-unit, multi-family, transit-oriented residential development with 232 parking stalls within a wrapped parking garage and storage for 47 bicycles, commonly

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br /> OF REDWOOD CITY, AS FOLLOWS: <br /> 1. The City Council, having independently heard, considered, and weighed <br /> all the evidence in the record presented on behalf of all parties and being fully informed <br /> of the Project, the Planning Commission's decision, and the two appeals, finds that <br /> neither First Appellant nor Second Appellant has shown, based on evidence in the <br /> record, that the Planning Commission's decisions were made in error, that there was <br /> an abuse of discretion by the Planning Commission, that the Planning Commission's <br /> decision was otherwise improper, or that the City's notices, agendas, and appeal <br /> procedures were unlawful in any manner. This determination is based, in part, on the <br /> Final EIR, the staff reports and attachments prepared for the Planning Commission <br /> hearings on the Project and the staff report and attachments prepared for the City <br /> Council on the Project and these appeals, each of which is incorporated herein by <br /> reference. Accordingly, the appeal is denied and the Planning Commission's December <br /> 13, 2011 actions are upheld as modified by the City Council. <br /> 2. The City Council has considered the Final EIR for the Project, and the <br /> Final EIR reflects the City Council's independent judgment. <br /> 3. The City Council affirms and adopts the CEQA Findings of Fact, the <br /> Mitigation Monitoring and Reporting Plan, and the Statement of Overriding <br /> Considerations previously adopted by the Planning Commission in Resolution No. 11- <br /> 07 (A Resolution of the Planning Commission of the City of Redwood City Certifying <br /> the Final Environmental Impact Report for the 2580 EI Camino Real Residential <br /> Project; Adopting CEQA Findings of Fact; Adopting a Mitigation Monitoring and <br /> Reporting Plan; and Adopting a Statement of Overriding Considerations, All in <br /> accordance with the Requirements of the California Environmental Quality Act). <br /> 4. Pursuant to CEQA Guidelines section 15091(e), the documents and other <br /> materials that constitute the record of proceedings upon which the City Council has <br /> based its decision are located in and may be obtained from, the Office of the City Clerk <br /> at 1017 Middlefield Road, Redwood City, California. The City Clerk is the custodian of <br /> records for all matters before the City. <br /> 5. In denying the appeals and approving Planned Development Permit No. <br /> PD2010-01, the City Council affirms and adopts the findings and conditions of approval <br /> adopted by the Planning Commission in Resolution No. 11-08 (A Resolution of the <br /> Planning Commission of the City of Redwood City Approving a Planned Development <br /> Permit and Modification of Parking Requirements pursuant to the City of Redwood City <br /> Zoning Ordinance), and adopts the following additional condition of approval to reflect <br /> the new affordable housing requirement as follows: <br /> The applicant shall execute and deliver to the City a recordable affordable <br /> housing covenant and deed restriction, in a form satisfactory to the City <br /> ATTY/RES0.2201/ATTACH. 1 DENY APPEALS FOR 2580 EL CAMINO REAL RESO. # 15169 <br /> REV:02/13/12 MUFF # 603 <br /> Page 3 of 5 <br />
