12/03/20 <br /> RECORDING REQUESTED BY <br /> AND WHEN RECORDE� MAIL TC): <br /> City of Redwood City <br /> 1017 Midd(efield Road <br /> Redwood City, CA 94063 <br /> Attn: City Clerk Department <br /> CONTRACT BETWEEN REDWOOD GTY AND ERIC AND LORI LOCHTEFELD <br /> FOR HISTORIC PROPERTY PRESERVATION OF 2215 BROADWAY STREET— <br /> THE FOX THEATRE <br /> THIS CONTRACT, made and entered into this day of , 2012, by <br /> and between the CITY �F REDWOOD CITY, a charter city and municipal corporation of <br /> the State of California, hereinafter called ("City"), and Eric and Lori Lochtefeld, <br /> hereinafter called ("Owner"); <br /> WITNESSETH: <br /> WHEREAS, California Gavernment Cade Sections 50280, et. seq, authorize <br /> cities to enter into contracts with the owners of qualified historical property to provide for <br /> the use, maintenance and restoration of such historical properfiy so to retain its <br /> characteristics as praperty of his#orical significance; and <br /> WHEREAS, Owners possess fee title in and to that certain rea! property, <br /> together with associated structures and improvements thereon and generally located at <br /> 2215 Broacfway Street, Redwood City, Califarnia 94063 (hereinafter such property shall <br /> be referred to as the "Historic Property"). A legal description of the Historic Property is <br /> attached hereto, marked as Exhibit "A," and is incorporated herein by this reference; <br /> and <br /> WHEREAS, on July 27, 1987, the City Council of the City of Redwood Cify by <br /> Resolution Na. 10565 declared and designated the Nistoric Property as a historic <br /> landmark pursuant to the terms and provisions of Chapter 40, Historic Preservation of <br /> the Redwood City Municipal Code; and <br /> WHEREAS, City and Owner, for their mufual benefit, now desire to enter into this <br /> Contract both to protect and preserve the charaeteristics of historical significance of the <br /> Historic Property and to qualify the Historic Property for an assessment of valuation <br /> pursuant to the provisions of Chapter 3, of Part 2, of Division 1 of the Caiifarnia <br /> Revenue and Taxation Cade. <br /> NOW, THEREFORE, CITY AND OWNER, in considera#ion of the mutual <br /> covenants and conditians set fiorth herein, do hereby agree as fallows: <br /> ATTY/AGR/2012.1841FOX THEATRE MILLS ACT CONTRACT <br /> REV:11-15-12 VR <br /> Page 1 of 10 <br /> RESO.# 15235 <br /> MUFF#612 <br />
