12/03/2012 <br /> 1. Effective Date and Term of Contract. The term of this Contract shall <br /> cammence on (the "effective date"), and shali expire ten years <br /> thereafter, to wit, on Thereafte�-, each year upon the <br /> anniversary of the effective date, the initial term will automatically be extended as <br /> pravided in paragraph 2. <br /> 2. Renewal. Each year on the anniversary af the effective date of this <br /> Contract (hereinafter referred to as the "renewal date"}, a year shal! automaticaEly be <br /> added to the initial term of this Contract unless saoner terminated in accordance with <br /> the provisions herein. <br /> 3. No#ice of Nonrenewal. <br /> a) if either Owner or City desires in any year not to renew the <br /> Contract, that party shall serve written nnfice of nonrenewal of the Contract on <br /> the other party in acivance of the annual renewa! date of the Contract. Unless <br /> sucn notice is served by �wner to City at least ninety (90) days prior to the <br /> annual renewal date, or served by City to Owner at least sixty (60) days prior to <br /> the annual renewal date, one (1) year shall be automatically added tn the term of <br /> the Contract. <br /> b) Upon receipt by Owner of a natice af nonrenewai from City, Owner <br /> may make a written protest af the notice of nonrenewal. City may, at any time <br /> prior to the renewal, withdraw the notice of nonrenewal. <br /> c) If either Gity or Owner serves notice of intent in any year r�ot to <br /> renew the Contract, the existing Contract shall remain in effect for the balance of <br /> the period remaining since the original execution or the last renewal of the <br /> Contract, as the case may be. <br /> 4. Standards for Historical Property. During the term of this Contract, the <br /> Historic Property shall be subject to the following conditions, requirements and <br /> restrictions and �wner agrees to same: <br /> a) Owner shall preserve and maintain the Characteristics of historical <br /> significance of tha Historic Property. Attached hereta, marked as Exhibit "B," and <br /> incorporated herein by this reference, is a list of those minimum standards and <br /> conditions for maintenance, use and preservation of the Historic Property, which <br /> shalE apply to such property throughout the term of this Contract. Owner shall <br /> also comply with the requirements set forth in Chapter 40 af the Code of the City <br /> of Redwood City and with the Secretary of the Interior's Rehabilitation Standards <br /> set forth in Exhibit "D," and incorporated herein by this reference. <br /> b) Owner shaEl, where necessary, restore and rehabilitate the property <br /> according to the rules and regulations of the Office of the Historic Preservation of <br /> the State Department of Parks and Recreation and in accordance with the <br /> ATTY/AGR/2612.185/726/728 BREWSTER MII�S ACT CONTRACT <br /> R�V:11-15-12 VR <br /> Page 2 of 10 <br /> RESO. # 15236 <br /> MUFF#612 <br />
