AND FIFTH AVENUE ENTERPRISES, INC., GRANTING THE <br /> APPEAL OF COSTCO WHOLESALE CORPORATION, AND <br /> MODIFYING THE PLANNING COMMISSION'S APPROVALS OF A USE <br /> PERMIT MODIFICATION AND A NEW ARCHITECTURAL PERMIT FOR <br /> THE COSTCO GASOLINE STATION EXPANSION PROJECT AT 2300 <br /> MIDDLEFIELD ROAD <br /> WHEREAS, Costco Wholesale Corporation ("Applicant") submitted applications <br /> to the City of Redwood City ("City") for modification of existing Use Permit No. UP2011- <br /> 44, and a new Architectural Permit No. AP2011-43 to expand its gasoline station <br /> operations from 12 to 20 fueling positions at 2300 Middlefield Road ("Expansion <br /> Project"); and <br /> WHEREAS, on October 16, 2012, the Planning Commission of the City of <br /> Redwood City held a duly noticed public hearing on the Expansion Project, considered <br /> Addendum No. 2 ("Addendum No. 2") to the 2007 Final Environmental Impact Report <br /> prepared for the Redwood City Costco Wholesale Project ("2007 EIR"), and approved <br /> the Use Permit Modification and Architectural Permit for 16 fueling positions <br /> (collectively, "Planning Commission Approvals"); and <br /> WHEREAS, on October 31, 2012, James M. Dombroski filed an appeal of the <br /> Planning Commission Approvals on behalf of Andy Saberi, Andy's BP, Inc. and Fifth <br /> Avenue Enterprises, Inc. ("Appellant"); and <br /> WHEREAS, on November 2, 2012, Applicant also filed an appeal of the Planning <br /> Commission Approvals; and <br /> WHEREAS, the City Council of the City of Redwood City ("City Council") is <br /> empowered by Article 48 (Appeals) to act upon appeals of Planning Commission <br /> decisions; and <br /> WHEREAS, on January 14, 2013, at the request of the Applicant with agreement <br /> by the Appellant, the City Council approved a motion to continue to the item to the <br /> March 11, 2013 meeting; and <br /> WHEREAS, on March 11, 2013, the City Council conducted a public hearing, in <br /> accordance with all applicable requirements of the State Planning and Zoning Law and <br /> the Redwood City Zoning Ordinance, to consider the Expansion Project and the appeals <br /> of the Planning Commission Approvals; and <br /> ATTY/RES0.2816/COSTCO RESO.#15249 <br /> REV:03-12-13 VR MUFF#603 <br /> Page 1 of 9 <br />
