RESOLUTION N0.15249 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD CITY DENYING THE APPEAL FILED BY ANDY SABERI, ANDY'S BP, INC. 03/11/2013 <br /> Section 3. As to Applicant's appeal of the Planning Commission Approvals, <br /> the City Council, having independently heard, considered, and weighed all the evidence <br /> in the record presented on behalf of all parties and being fully informed of the Project, <br /> the Planning Commission Approvals, and the two appeals, finds that Applicant has <br /> responded to some of the Planning Commission's concerns and comments. <br /> Accordingly, the appeal filed by Applicant Costco Wholesale Corporation is granted, and <br /> the Planning Commission's October 14, 2012 actions are modified by the City Council to <br /> allow a 20 fuel pump station, as provided below. <br /> Section 4. Addendum No. 2: The City Council finds that: <br /> a. Addendum No. 2 was prepared in accordance with all legal requirements, <br /> including CEQA Guidelines Section 15164. <br /> b. The City Council reviewed and considered Addendum No. 2 and other <br /> information in the entire record and has considered the information contained therein, <br /> including the written and oral comments received at the public hearing on Addendum <br /> No. 2 and the Project, prior to acting upon or approving the Project; and Addendum No. <br /> 2 represents the independent judgment of the City of Redwood City. <br /> c. None of the criteria set forth in the CEQA Guidelines Section 15162 has <br /> been triggered. The Approved Project does not trigger the need for a Supplemental or <br /> Subsequent EIR under Section 15162 of the CEQA Guidelines because there are no <br /> new significant impacts; therefore, the Approved Project will not result in any new or any <br /> increase in the severity of previously identified impacts and no new mitigation measures <br /> are required beyond those identified in the 2007 EIR. <br /> d. Pursuant to Guidelines Section 15091(e), the documents and other <br /> materials that constitute the record of proceedings upon which the City Council has <br /> based its decision are located in and may be obtained from, the Office of the City Clerk <br /> at 1017 Middlefield Road, Redwood City, California. The City Clerk is the custodian of <br /> records for all matters before the City. <br /> Section 5. Use Permit UP2011-44: The City Council finds that: <br /> a. The expanded use will be consistent with the various elements and <br /> objectives of the General Plan and any zoning regulations for the subject location. The <br /> expanded use would be located within an existing developed gasoline station site. The <br /> General Plan land use designation for the project site is Commercial-Regional which <br /> allows for the development of general retail, commercial services, restaurants, vehicle <br /> sales and service, and other similar business activities. The site is also zoned Industrial- <br /> Restricted, which promotes viable industrial areas by providing a district for the location <br /> of selected industries, wholesale establishments, specified retail establishments, and <br /> heavy commercial uses which can congregate together. Fueling centers are permitted <br /> in the IR Zoning District subject to approval of a Use Permit.
