03/25/2013 <br /> Sectian 3.1�3 Water Sut�ply Agreement Amendment Rec�uired <br /> San Francisco may not chan�e the existing canditian of the Hetch Hetchy <br /> Reservair by: <br /> (1) abandonina or decommissioning C7`Shaughnessy Dam; or <br /> (2) draining Hetch Hetchy Reservoir, except for purpases nf(i) repair, <br /> rehabilitation, maintenance, improvement; or reconstruction of <br /> O'Shaug,hnessy Dam or appurtenances, (ii) supplyiTlg water to the B�y <br /> Area during drou;ht,or(iii) meeting cvater release requirernents under the <br /> Raker Act, or federal or state law, <br /> unl�ss th� parties enter into an amendment t�o the Water Supply Agreement, in fu11 <br /> force and effecx, adopted in accardance wiCli Section 2.Q3. <br /> The amendment sYiall state, or t�esCate, as the case may be: <br /> A. The level of service goals for seismic reliability and delivery reliability <br /> aclapted by the Commission in conjunction with such prnposed changes to <br /> the Regional V�later Systern, provided such goals are at least as protective <br /> af the Whalesale Custamers as t�ie level of service goals aclo�ted by the <br /> Commission on Octob�r 3Q, 2008 in cflnjunction with the WSIP; <br /> B. The level of water quality to be delivered, which is currently provided for <br /> in Section 3.0$, and <br /> C. The specific cast allocatian pracedures,written�s an arnendment to <br /> Articl� 5, whict� apply to �l) the abandonment or decommissioning of <br /> O'Shaughnassy Dam, ar(2) rhe draining of Hetch Hetchy Reservoir, and <br /> {3) the development, operation and maintenance of New Regional Assets <br /> that may be required to rep(rice water supplied by Hetch I-ietchy Reservoir <br /> and cielivered tp the Bay Area. <br /> In the event that the �arties are not able ta agree upon and approve an amendment <br /> to the Water Supply Agreement as set forth above, San Francisco may not <br /> abandon or decommission C}'5�zaughnessy Dam or drain Hetch Hetchy Reservoir. <br /> February 5, 2013 , <br /> RESO.#15255 <br /> MUFF#304 <br />
