06/24/2013 <br /> ORIGINAL <br /> RESOLUTION NO. 15281 <br /> RESOLUTION OF THE CITY OF REDWOOD CITY APPROVING THE <br /> SECOND AMENDED AND RESTATED JOINT EXERCISE OF POWERS <br /> AGREEMENT FOR THE SOUTH BAYSIDE WASTE MANAGEMENT <br /> AUTHORITY <br /> WHEREAS, the Joint Exercise of Powers Agreement (JPA) for the South <br /> Bayside Waste Management Authority (SBWMA) was entered into on December 9, <br /> 1999; and <br /> WHEREAS, the member agencies amended the JPA on June 4, 2002, to change <br /> the definition of"Fiscal Year"; and <br /> WHEREAS, the member agencies first amended and restated the Joint Exercise <br /> of Powers Agreement on January 17, 2006 to: establish the position of Executive <br /> Director; include items that require member agency approval; clarify member agency <br /> staff positions for Board membership; and to have the Board annually select the Chair; <br /> and <br /> WHEREAS, an SBWMA Blue Ribbon Task Force was convened and <br /> recommended that member agencies approve a Second Amended and Restated Joint <br /> Exercise of Powers Agreement to modify the composition of the Board from an <br /> executive employee of each member agency to an elected official from each member <br /> agency. <br /> NOW, THEREFORE, BE IT RESOLVED that the City Council approves the <br /> Second Amended and Restated Joint Powers Agreement for the South Bayside Waste <br /> Management Authority modifying the composition of the Board from an executive <br /> employee of each member agency to an elected official from each member agency. <br /> * * � <br /> ATTY/RES0.2876/SBWMA JPA—SECOND AMENDED RESTATED RESO.#15281 <br /> REV:06-20-13 PT MUFF#304 <br /> Page 1 of 1 <br />
