COMPLIANCE WITH CALIFORNIA LABOR LAWS AND FEDERAL <br /> REQUIREMENTS. Contractor agrees to be bound by the Labor Laws of the State of <br /> California, and applicable Federal requirements. A paragraph shall be incorporated in <br /> every agreement between Contractor and third parties in connection to the Project <br /> stating that the third party must comply with California Labor Laws and applicable <br /> Federal requirements. Pursuant to 42 USC 5310, all laborers and mechanics employed <br /> by contractors or subcontractors in the performance of construction work financed in <br /> whole or in part with assistance received from the HOME Investment Partnership Act <br /> shall be paid wages at rates not less than those prevailing on similar construction in the <br /> locality as determined by the Secretary of Labor in accordance with the Davis-Bacon <br /> Act, as amended (40 U.S.C. 276a--276a-5): Provided, that this section shall apply to <br /> the rehabilitation of residential property only if such property contains not less than 11 <br /> units. The Secretary of Labor shall have, with respect to such labor standards, the <br /> authority and functions set forth in Reorganization Plan Numbered 14 of 1950 (15 F.R. <br /> 3176; 64 Stat. 1267) and section 276c of title 40, as may be amended from time to <br /> time. The Wage and Hour Division of the Employment Standards Administration <br /> administers and enforces the Davis-Bacon Act.
