07/22/2013 <br /> c. The design and proposed improvements are not likely to <br /> cause substantial environmental damage, or substantially <br /> and unavoidably injure fish, wildlife or their habitat, or cause <br /> serious public health problems; and <br /> d. The design and proposed improvements of the proposed <br /> subdivision will not conflict with essential public easements <br /> for access through, or use of, property within the proposed <br /> subdivision. <br /> Section 4. Downtown Planned Community Permit DPC2013-02: <br /> Subject to approval of the Downtown Precise Plan Amendment proposed <br /> concurrently with this Project, the City Council finds that: <br /> a. The project and improvements proposed by Planned <br /> Community Permit Application No. DPC2013-02 are <br /> consistent with, conform to the intent of, and will <br /> appropriately implement the Downtown Precise Plan for the <br /> 950 Middlefield Road Project; and <br /> b. The establishment, maintenance and operation of the project <br /> and improvements proposed by Planned Community Permit <br /> No. DPC2012-12 will not, under the circumstances of this <br /> particular case, be detrimental to the health, safety peace, <br /> morals, or general welfare of persons residing or working in <br /> the neighborhood of the project, or be detrimental or <br /> injurious to property or improvements in the neighborhood of <br /> the project, or to the general welfare of the City, because the <br /> project has been found to be consistent with the community <br /> goals established in the City's General Plan and Zoning <br /> Ordinance; and <br /> c. The Project and improvements comply fully with all <br /> applicable standards and guidelines of the DTPP. <br /> Section 5. The City Council hereby approves the Vesting Tentative Parcel <br /> Map (TM2013-03) and the Planned Community Permit (DPC2013-02) based on <br /> the City Council's consideration and reliance on the Initial Study Checklist and in <br /> accordance with the plans, details and descriptions contained therein, attached <br /> hereto and incorporated herein by reference, and subject to the following <br /> Conditions of Approval: The City Council further authorizes the City Manager to <br /> execute the Subdivision/Improvement Agreement, the Landscape Maintenance <br /> Agreement, and the Stormwater Treatment Measures Maintenance Agreement <br /> required as part of the following Conditions of Approval. <br /> ATTY/RE50.2884/APPROVAL OF VTM and PCP FOR 950 MIDDLEFIELD ROAD RESO.�i 15288 <br /> REV:07-15-13 VR MUFF#100 <br /> Page 3 of 30 <br />
