._, __ a. <br /> EXHIBIT"H" <br /> TO <br /> DISPOSITION AND DEVELOPMENT AGREEMENT <br /> SCOPE OF DEVELOPMENT/SCHEMATIC DRAWING5 <br /> I. DEVELOPER'S IMPROVEMENTS <br /> A. General <br /> The Developer agrees that the Site shall be developed and improved in <br /> accordance with the provisions of this Agreement and the plans, drawings and related documents <br /> appzoved by the City pursuant hereto. The Developer, its supervising architect, engineer and <br /> contractor, shall work with City staff to coozdinate the overall design, architecture and color of <br /> the improvements on the Site. <br /> B. The Project <br /> The entire Site is comprised of real property, a portion of which is owned by the <br /> Developer, and the remaining portion of which is owned by the City and will be acquired by the <br /> Developer for development of the Project, in accordance with this Agreement. <br /> ' It is the intent of the Parties that the Site shall be developed as a mixed use <br /> ' commercial / retail project, including: approximately 295,350 square feet of Class A office <br /> space, 5,075 square feet of retail space, 5,630 squaze feet of circulation space, and above ground, <br /> at grade and underground pazking with approximately 904 pazking spaces. The Project shall be <br /> developed in accordance with the approved Schematic Drawings, attached hereto as Exhibit 1 <br /> and incorporated herein by reference. <br /> The Developer shall use commercially reasonable efforts to ensure that there shall <br /> be no employee-only food preparation service facilities maintained by the office tenants and that <br /> all eating establishments located and operating on the Site are open to the public. For purposes <br /> ' of this Agreement, eating establishments shall not include coffee bars, snack bars, wet bars and <br /> other similar limited food service facilities intended to serve office tenants. <br /> C. Developer Fees <br /> The Developer shall be�responsible for paying all applicable fees. The following is <br /> a list of fees chazged by the City upon development as of the date of this Agreement.
