<br />RE <br />10/07/2013 <br />ORIGINAL <br /> <br />RESOLUTION NO. 15300 <br /> <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />REDWOOD CITY DENYING THE APPEAL FILED BY KELLIE <br />GUINTO, UPHOLDING THE PLANNING COMMISSION ACTIONS <br />GRANTING A MODIFICATION AND APPROVING A PLANNED <br />DEVELOPMENT PERMIT FOR THE 1410 VALOTA ROAD <br />RESIDENTIAL PROJECT PURSUANT TO THE CITY OF <br />REDWOOD CITY ZONING ORDINANCE <br /> <br /> <br />WHEREAS <br />, on April 3, 2012, the Planning Commission (“Commission”) <br />considered and adopted an Initial Study/Mitigated Negative Declaration for the <br />1410 Valota Road Residential Project (“IS/MND”) prepared by the City’s Planning <br />Services in accordance with the requirements of the California Environmental <br />Quality Act (“CEQA”) and, based on the adopted IS/MND, considered and <br />adopted a Mitigation Monitoring and Reporting Program in compliance with all <br />CEQA requirements for the Project; and <br /> <br />WHEREAS <br />, on April 3, 2012, the Commission also approved Planned <br />Development Permit Application No. PD2011-01 and Vesting Tentative Map <br />Application No. TM2012-01 (including Exceptions to the Subdivision Ordinance); <br />and <br /> <br />WHEREAS <br />, pursuant to Section 46.11, the Planned Development Permit <br />No. PD2011-01 has automatically terminated and is of no further effect; and <br /> <br />WHEREAS <br />, the Commission’s approval of the Vesting Tentative Map <br />(including Exceptions to the Subdivision Ordinance) by Resolution No. 12-10 <br />remains in effect until April 3, 2014, per the Subdivision Map Act; and <br /> <br />WHEREAS <br />, in accordance with Section 46.11 of the Redwood City Zoning <br />Ordinance, 1410 Valota Road Partners LLC (“Applicant”) submitted a new <br />Planned Development Permit Application No. PD2013-04 for the 1410 Valota <br />Road Residential Project (“Project”); and <br /> <br />WHEREAS <br />, on July 2, 2013, the Commission conducted a duly noticed <br />public hearing, in accordance with all applicable requirements of the State <br />Planning and Zoning Law and the Redwood City Zoning Ordinance, to consider <br />ATTY/RESO.2916/ 1410 VALOTA PD APPEAL RESO RESO #15300 <br />REV: 09-27-13 VR MUFF #603 <br />Page 1 of 3 <br /> <br />
