03/24/2014 <br /> judgment, hereby denies the appeal and approves the Planned Development <br /> Permit (including Modifications), Tentative Map, and Condominium Permit based <br /> on the following findings and subject to the Conditions of Approval set forth <br /> below. This determination is based on the entire record, including the application <br /> materials, 2003 EIR, Addendum No. 1 and Revised Addendum No. 2, the staff <br /> reports and attachments prepared for the Planning Commission hearings on the <br /> Project and the staff report and attachments prepared for the City Council on the <br /> Project and the appeal, each of which is incorporated herein by reference and <br /> which serve as an adequate and appropriate evidentiary basis for the findings <br /> and actions set forth in this Resolution. <br /> Section 2. Revised Addendum No. 2: In the exercise of its <br /> independent judgment, the City Council finds that: <br /> a. Revised Addendum No. 2 was prepared in accordance with <br /> all legal requirements, including CEQA Guidelines section <br /> 15164. <br /> b. The City Council has reviewed and considered Revised <br /> Addendum No. 2 along with ihe previously certified Marina <br /> Shores Village Environmental Impact Report (2003 EIR) and <br /> associated Addendum No. 1 (2007) and other information in <br /> the entire record and has considered the information <br /> contained therein, including the written and oral comments <br /> received at the public hearing on the Project, prior to acting <br /> upon or approving the Project. <br /> c. Based on substantial evidence in the record, the proposed <br /> Project is within the scope of the previously certified Marina <br /> Shores Village Environmental Impact Report (2003 EIR) for <br /> the purposes of CEQA. The mitigation measures and <br /> Statement of Overriding Considerations associated with <br /> certification of the 2003 EIR address the environmental <br /> effects of the Project. Accordingly, all applicable mitigation <br /> measures and the Statement of Overriding <br /> Considerations for the significant unavoidable impacts, <br /> including without limitation Impact 7-15 (Cumulative <br /> [2020] With Project Impact on the EI Camino Real / <br /> Whipple Avenue Intersection), are hereby reconfirmed <br /> and readopted. <br /> d. As set forth in CEQA Guidelines section 15162(a), there are <br /> no new significant impacts nor any increase in the severity of <br /> previously identified impacts and no new mitigation <br /> measures are required beyond those identified in the 2003 <br /> EIR. More specifically: <br /> 1. There are no substantial changes proposed to <br /> the Project which would require major revisions to the 2003 <br /> ATTY/RE50.2967/CC PETE'S HARBOR—DENYING APPEALAND APPROVING PROJECT Reso#15336 <br /> REV:03-25-14 VR Muff#603 <br /> Page 3 of 19 <br />
