WHEREAS, on November 8, 2013, the City released the Final EIR for a 10-day
<br /> public review period pursuant to CEQA and the CEQA Guidelines; and
<br /> WHEREAS, on December 10, 2013, the Commission held a duly noticed public
<br /> hearing, in accordance with all applicable requirements of the State Planning and
<br /> Zoning Law and the Redwood City Zoning Ordinance, received and considered oral and
<br /> documentary evidence on the application, considered and certified the Final EIR for the
<br /> Project prepared in accordance with the requirements of CEQA, the CEQA Guidelines,
<br /> and the Redwood City Municipal Code and Zoning Ordinance, did adopt the CEQA
<br /> Findings of Fact, did not adopt the Statements of Overriding Consideration, denied the
<br /> Use Permit application, and directed staff to return to the Commission with revised
<br /> resolutions for denial of the Project; and
<br /> WHEREAS, on February 4, 2014, the Commission reviewed revised Planning
<br /> Commission Resolution Nos. 13-29 and 13-30, certifying the Final EIR, adopting CEQA
<br /> Findings of Fact, declining to adopt Statements of Overriding Consideration, and
<br /> denying the Use Permit application; and
<br /> WHEREAS, on February 18, 2014, an appeal of the Planning Commission
<br /> actions was filed by Applicants; and
<br /> WHEREAS, on April 21, 2014, Applicants submitted a request to schedule the
<br /> appeal hearing on July 28, 2014, to provide Applicants with additional time to prepare
<br /> for the appeal; and
<br /> WHEREAS, on July 28, 2014, the Council held a public hearing, duly noticed in
<br /> accordance with legal requirements, on consideration of the appeal and the Project; and
<br /> WHEREAS, the Applicants and all other interested parties were given the
<br /> opportunity to participate in the public hearing through oral testimony and the submittal
<br /> of written comments; and
<br /> WHEREAS, on July 28, 2014, the City Council fully reviewed, considered, and
<br /> evaluated the Project's Final EIR, staff reports prepared for the Project including the
<br /> attachments to the staff reports, oral and written public testimony, and all other
<br /> documents and evidence in the public record on the Project and the appeals.
<br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
<br /> OF REDWOOD CITY, AS FOLLOWS:
<br /> 1. The City Council, having independently heard, considered, and weighed
<br /> all the evidence in the record presented on behalf of all parties and being fully informed
<br /> of the Project, the Planning Commission's decision, and the appeal, finds that
<br /> Applicants have not shown, based on evidence in the record, that the Planning
<br /> Commission's decisions were made in error, that there was an abuse of discretion by
