04/13/2015 <br /> 7.3.A. - Page 16 <br /> 1606 Middlefield Road Relocation Plan <br /> "Last Resort Housing" payments are authorized by statute if affordable <br /> "comparable replacement housing" cannot be located for the displaced tenant <br /> household (i.e., housing renting for not more than 30% of the household's gross <br /> monthly income). In such an instance, payments may be made beyond the <br /> $5,250.00 statutory cap, up to forty-two (42) months' worth of rental assistance. <br /> Any supplemental increment beyond $5,250.00 may be paid in installments or, a <br /> lump sum, at the City of Redwood City's discretion. <br /> I. PAYMENT OF RELOCATION BENEFITS <br /> Relocation benefit payments will be made expeditiously. Claims and supporting <br /> documentation for relocation benefits must be filed with the City within eighteen <br /> (18) months from the date the claimant moves from the displacement property. <br /> Procedures for preparing and filing of claims and processing and delivering of <br /> payments are included in this Plan as Attachment 3. <br /> J. EVICTION POLICY <br /> The occupants are tenants of the City. The City recognizes that eviction is <br /> permissible only as a last resort and that relocation records must be documented <br /> to reflect the specific circumstances surrounding any eviction. Eviction will only <br /> take place in cases of nonpayment of rent; serious violation(s) of the rental <br /> agreement; a dangerous or illegal act performed by Lessee, its employees, <br /> invitees or, any combination thereof in the unit; or, if the lessee/displacee refuses <br /> all reasonable offers to move. Eviction will not affect the eligibility of a person <br /> legally entitled to relocation benefits. <br /> K. APPEALS POLICY <br /> Any person ("Occupant") who is aggrieved by a determination as to eligibility, <br /> the amount of payment, or the public entity's provision of comparable permanent <br /> or adequate temporary replacement housing ("the Determination"), will be <br /> afforded an opportunity to file an appeal with the City disagreeing with the Initial <br /> Determination made by the Relocation Advisor. An Occupant shall first contact <br /> his Relocation Advisor to see if the situation can be mutually resolved. If not, <br /> the Occupant may present a request for an informal oral presentation to the <br /> City's Project Manager, as designated by the City Manager, who has the <br /> authority to revise the Determination.
