Downtown Mitigation Measures — The applicant shall implement and comply with all <br /> applicable mitigation measures described in the Environmental Impact Report(EIR) and <br /> Mitigation Monitoring Program (MMRP) for the Downtown Precise Plan, adopted by the <br /> City Council by Resolution No. 15086, including mitigations expressly identified in the <br /> Initial Study for this project. Downtown TDM — Prior to issuing a certificate for building occupancy, the applicant <br /> shall provide a final transportation demand management (TDM) program (acceptable to <br /> the City Engineer) which outlines program elements to be implemented by property <br /> management and by the tenant(s). The program shall include an annual reporting <br /> requirement detailing parking utilization rates, TDM program use, and employee mode <br /> choice, due on December 1 st of each year. The reporting requirement will continue until <br /> the project's parking garage reaches an average weekday occupancy of 95% and <br /> thereafter for three years. Whenever the project's average weekday parking occupancy <br /> reaches or exceeds 95%, the property owner will have 3 months to revise and resubmit <br /> their TDM program to the City, outlining how the program will further incentivize a <br /> reduction in vehicle trips to the site. Notice of Right — The applicant shall submit a "Notice of Right to Downtown <br /> Operations" to all tenants prior to execution of any lease per Section 2.2.6 of the DTPP. <br /> [COA][PLANNING] <br /> 84. Window Visibility — Ground floor windows for non-residential uses shall provide an <br /> unobstructed view into the building of at least 20 feet. [SDR][PLANNING] <br /> 85. Downtown Model -The applicant shall provide for the City's use a scaled model of <br /> the project or adequate funds to build the scaled model for purposes of adding to <br /> the City's scaled model of Downtown prior to issuance of permits.
