Notice Of Fees Protest — The applicant may protest any fees, dedications, <br /> reservations, or other exactions imposed by the City as part of the approval or as a <br /> condition of approval of this development. Per California Government Code Section <br /> 66020, this 90-day protest period has begun as of the date of the approval of this <br /> application. [SDR][OFFICE OF THE CITY ATTORNEY] <br /> Architectural Advisorv Committee Conditions <br /> 7. Prior to the issuance of a building permit, the applicant shall work with Planning staff to <br /> schedule a meeting with the Architectural Advisory Committee to review and approval <br /> of final design details. <br /> Historic Resources Advisorv Committee Conditions <br /> 8. Prior to demolition and rehabilitation, the applicant shall photographically document the <br /> Fox Theatre loading dock and dressing-room wing. <br /> Buildina Department Conditions <br /> 9. Accessible parking spaces shall be provided in the project's underground garage in <br /> accordance with California Building Code requirements. <br /> 10. The height clearance for the project's underground garage shall comply with the vertical <br /> clearance requirements per IIB-502.5 Vertical Clearance. Parking spaces, access <br /> aisles and vehicular routs serving them shall provide a vertical clearance of 98 inches <br /> (2489 mm) minimum. The applicant shall verify the actual depth of existing utilities <br /> through pot-holing. <br /> 11. The applicant shall ensure that the project complies with all applicable fire, building, and <br /> Iife safety codes and requirements. <br /> 12. The grease interceptor shall be located not more than 90 feet to a pump truck on Theatre <br /> Way in order to be pumped out. The location of the grease interceptor may remain, if <br /> pump truck access is determined to be sufficient to the satisfaction of the Community <br /> Development Director. <br /> 13. The applicant shall address the location of the utilities in relation to the height of the <br /> parking level ceilings. The connection between the parking garages is an accessible <br /> path for vehicles. Ninety-eight (98) inches in the clear is required under pipes or other <br /> projections to allow for taller vehicles traveling through. If the applicant demonstrates <br /> that it is technically infeasible, the passage shall be highly marked and equipped with a <br /> warning system to warn taller vehicles not to enter. <br /> 14. The openings in the Fox Theatre in proximity to the new building and property lines shall <br /> be addressed for fire resistance and code compliance. The building overhanging of the <br /> adjacent parcel requires an Alternate Method Material Request(AMMR)to be submitted <br /> by the applicant and approved by the Fire Marshal and Building Official. The AMMR <br /> needs to be designed and submitted by a Fire Protection Engineer.
