09/21/2015 <br />ATTY/RESO.3134/CC RESO APPROVING PLANNED DEVELOPMENT – FINGER RESO. # 15445 <br />REV: 09‐17‐15 VR MUFF # 613 <br />Page 1 of 29 <br />ORIGINAL <br /> <br />RESOLUTION NO. 15445 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br />CITY APPROVING A PLANNED DEVELOPMENT PERMIT INCLUDING <br />MODIFICATIONS, USE PERMIT, AND VESTING TENTATIVE MAP <br />INCLUDING MODIFICATIONS FOR AN EIGHT LOT RESIDENTIAL <br />SUBDIVISION, PURSUANT TO THE CITY OF REDWOOD CITY <br />ZONING ORDINANCE, THE REDWOOD CITY MUNICIPAL CODE, AND <br />THE SUBDIVISION MAP ACT, AND UPON CONSIDERING ADDENDUM <br />NO. 1 AND ADDENDUM NO. 2 WITH THE FINGER AVENUE NINE-LOT <br />PLANNED DEVELOPMENT PROJECT EIR, AS CERTIFIED <br /> <br /> WHEREAS, Kirk McGowan dba McGowan Development (“Applicant”) submitted <br />applications to the City of Redwood City (“City”) for a Planned Development Permit, <br />including Modifications to zoning district regulations, and a Vesting Tentative Map <br />including Modifications to the Subdivision Ordinance for a nine lot residential subdivision <br />(”Applicant’s Original Proposed Project”); and <br /> <br />WHEREAS, the Planning Commission of the City of Redwood City <br />(“Commission”) is empowered by Article 46 (Planned Development Permits) and Article <br />42 (Use Permits) of the City of Redwood City Zoning Ordinance to act upon applications <br />for planned development permits and use permits within single-family residential zoning <br />districts; the Commission is also empowered by the Subdivision Map Act and the <br />Redwood City Municipal Code to consider Vesting Tentative Map Applications; and <br /> <br />WHEREAS, on September 10, 2012, the City Council adopted Resolution No. <br />15217, certifying the Final EIR prepared by the City in accordance with the <br />requirements of CEQA and, based on the EIR, adopted a Mitigation Monitoring and <br />Reporting Program in compliance with all CEQA requirements; and <br /> <br />WHEREAS, on September 10, 2012, the City Council adopted Resolution No. <br />15218, approving the Planned Development Permit, including modifications to the <br />required R-1 zoning district development standards, based on findings, in consideration <br />of the certified EIR and subject to conditions of approval; and <br /> <br />WHEREAS, on September 10, 2012, the City Council adopted Resolution No. <br />15219, approving the Vesting Tentative Map, including modifications to required street <br />design standards, based on findings, in consideration of the certified EIR and subject to <br />conditions of approval; and <br /> <br />WHEREAS, on October 11, 2012, Friends of Cordilleras Creek (“Friends”) filed <br />suit against the City of Redwood City and the Applicant in the Superior Court of the <br />State of California, County of San Mateo, challenging the City’s certification of the EIR <br />and project approvals; and
