09/21/2015 <br />ATTY/RESO.3134/CC RESO APPROVING PLANNED DEVELOPMENT – FINGER RESO. # 15445 <br />REV: 09‐17‐15 VR MUFF # 613 <br />Page 12 of 29 <br />Ordinance, the California Subdivision Map Act and the City of Redwood <br />City Municipal Code, and all applicable subdivision improvement <br />requirements. <br /> <br />(b) The site of the proposed subdivision is physically suited for an eight lot <br />residential development. <br /> <br />(c) The Project and associated improvements would not likely cause <br />substantial environmental damage, substantially injure fish, wildlife or their <br />habitat, or cause serious public health problems. <br /> <br />(d) The Project and associated improvements would not conflict with essential <br />public easements for access through, or use of, property within the <br />proposed subdivision. The Project and associated improvements would <br />meet all necessary criteria consistent with the above, if and where <br />applicable. <br /> <br />(e) Modifications to the street design criteria identified in Section 8 complies <br />with requirements for findings described in Section 30.118. No exception <br />to the Subdivision Ordinance is being sought, therefore Section 30.69 <br />does not apply. However, to the extent that the modification is construed <br />to require an exception, such exception complies with the requirements for <br />findings described in Section 30.69 as identified in Section 8 (below). <br /> <br />(f) The map for eight residential lots and a remainder common lot and <br />associated improvements, would be consistent with written public policy <br />and with the public interest. Refer to Draft EIR pages 173-179 that <br />describes the Applicant’s Original Proposed Project’s consistency with <br />regional and community plans/policies. <br /> <br />Section 8. Modification to the Street Design Criteria of the Subdivision <br />Ordinance (Section 30.118) to allow a 22-foot wide, one-way roadway inclusive of a 2- <br />foot wide rolled curb & gutter and attached 4-foot wide pervious paver walkway on one <br />side where the Subdivision Ordinance calls for a 54-foot right-of-way with a 34-foot <br />roadway width and two lanes. The City Council finds that: <br /> <br />(a) Consistent with Municipal Code Section 30.118 B: <br /> <br />1. Municipal Code Chapter 30 (Subdivisions) Section 30.118 B allows <br />modifications to street design criteria if a Planned Development (PD) <br />Permit has been approved or if the exception is in the public interest. <br /> <br />2. With the approval of a Planned Development (PD) Permit for the <br />Project, modifications to the otherwise applicable street design criteria <br />for the private roadway would be allowed.
