09/21/2015 <br />ATTY/RESO.3134/CC RESO APPROVING PLANNED DEVELOPMENT – FINGER RESO. # 15445 <br />REV: 09‐17‐15 VR MUFF # 613 <br />Page 3 of 29 <br /> <br />WHEREAS, the Planning Commission determined that certain necessary <br />findings for approval of the proposed Planned Development Permit including <br />modifications for reduced setbacks, Use Permit to allow construction of residential <br />structures and associated impervious improvements within the 25’ creek protection <br />setback, and Vesting Tentative Map with modifications to create a nine lot subdivision <br />with a reduced width private one-way roadway could not be made; and <br /> <br />WHEREAS, the Planning Commission determined that an eight lot subdivision <br />alternative that would 1) Remove building and impervious surface encroachments from <br />the 25’ creek protection setback, 2) Minimize the number of internal Planned <br />Development Permit modifications and eliminate the Planned Development Permit <br />modifications adjacent to existing homes, and 3) Distribute the guest parking spaces <br />throughout the project site would further the purposes of and appropriately implement <br />the City of Redwood City General Plan, applicable provisions of the Redwood City <br />Municipal Code and Zoning Ordinance; and <br /> <br />WHEREAS, on August 17, 2015, the Applicant submitted an amended Planned <br />Development Permit, Use Permit and Vesting Tentative Map application for an eight lot <br />residential subdivision that substantially complies with the Planning Commission’s <br />recommendation (Project); and <br /> <br />WHEREAS, on September 21, 2015, the City Council conducted a duly noticed <br />public hearing, in accordance with all applicable requirements of the State Planning and <br />Zoning Law and the Redwood City Zoning Ordinance to consider Planned Development <br />Permit Application No. PD2008-06 including modifications, Use Permit No. UP2015-23, <br />and Vesting Tentative Map Application No. TM2008-08 including modifications, and <br />received and considered oral and documentary evidence on the applications; and <br /> <br />WHEREAS, the City Council has determined that the proposed eight lot <br />residential subdivision would further the purposes of and appropriately implement the <br />City of Redwood City General Plan, applicable provisions of the Redwood City <br />Municipal Code and Zoning Ordinance. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF REDWOOD CITY AS FOLLOWS: <br /> <br />Section 1. The City Council finds that the above recitals are accurate <br />and constitute findings in this matter and, together with the Staff Report and the <br />application materials, including without limitation the Final EIR and subsequent <br />Addendum Nos. 1 and 2, development plan, vesting tentative map, use permit, and <br />all other documents, reports, studies, memoranda, maps, oral and written testimony, <br />and materials in the City’s file for the applications, and all adopted City planning <br />documents relating to the Project and the property including the City’s General Plan, <br />Municipal Code, Zoning Ordinance, and other applicable City laws and regulations, and <br />all associated approved and certified environmental documents, have together served
